Pursuant to Act 247 of 1968, known as the "Pennsylvania Municipalities
Planning Code," as amended, supplemented and in effect, there is hereby created a Township Planning Commission.
[Amended 8-4-1986 by Ord. No. 8486-A; 3-5-2002
by Ord. No. 2002-3]
The Township Planning Commission shall consist of seven members, who
shall be residents of the Township, who shall be appointed by the Township
Board of Supervisors and who shall serve for terms as provided by law. The
members of the existing Planning Commission shall continue in office until
the end of the term for which they were appointed. No Township funds may be
expended by the Planning Commission without prior written approval of the
Township Board of Supervisors.
The Planning Commission shall have the power and duties to do everything
outlined in the Act 247 of 1968, the Municipalities Planning Code, as amended, and any other power and duty consistent with its mandated authority
or duties delegated to it by the Board of Supervisors, and shall not have
the power to grant formal approval, but its determination shall be recommending
only and not formal action on plans.
Any member of the Planning Commission, once qualified and appointed,
may be removed from office for malfeasance, misfeasance or nonfeasance in
office or for any other just cause, by a majority vote of the Board of Supervisors.
The member shall receive 15 days' advance notice of the intent of the
Board of Supervisors to take such a vote, and a hearing shall be held in connection
with the vote if the member so requests it in writing. Any appointment to
fill a vacancy created by removal shall be only for the unexpired term.
