It shall be unlawful for any person to throw any projectile from any
sling, catapult, pea shooter or air gun or shoot an arrow with any bow or
crossbow upon any street, sidewalk or other public place.
It shall be unlawful for any person to throw any stone, stick or other
thing whereby any person may be or shall be hit or hurt or any window broken
or other property belonging to another injured or destroyed.

Notwithstanding any other provision of this Code to the contrary, any
person desiring to discharge a weapon upon any street or sidewalk or upon
or in any public or private place within the City shall file
an application for a weapons discharge permit with the Chief of Police, and
in such application shall be set forth the following:
A.
The date and hours for the discharge and the expected
duration thereof.
B.
The street, sidewalk or public or private places over
and upon which the discharge is to take place.
C.
The number of persons, vehicles and animals expected
to congregate for the discharge.
D.
The purpose of the discharge.
E.
The names and addresses of the actual sponsors of the
discharge and the organization or organizations, if any, of which the expected
participants are members.
F.
The name and address of the person who shall be in charge
of such discharge and who shall be responsible for the conduct thereof and
for compliance with all applicable provisions of law, this Code and other
ordinances, rules and regulations by the participants in such discharge.
G.
Any additional information which the Chief of Police
shall find reasonably necessary to a fair determination as to whether a permit
should issue.
The Chief of Police shall issue a permit as provided for hereunder when,
from a consideration of the application and from such other information as
may otherwise be obtained, he finds that:
A.
The conduct of the discharge will not substantially interrupt
the safe and orderly movement of traffic contiguous to the place of discharge.
B.
The concentration of persons, animals and vehicles at
discharge points will not unduly interfere with proper fire and police protection
of or ambulance service to areas contiguous to such discharge points.
C.
The conduct of the discharge is not reasonably likely
to cause injury to persons or to property, to provoke disorderly conduct or
create a disturbance.
D.
Discharge precautions will be taken so as to prevent
the projectiles from traversing any grounds or space outside the limits of
such grounds upon which the discharge is proposed.
E.
The discharge is not for the purpose of hunting.
F.
Evidence of general liability insurance in an amount
to be approved by the City Attorney is presented with a certificate made out
in the name of the City of Colonial Heights.
Any person aggrieved shall have the right to appeal the denial of a
discharge permit to the City Council. The appeal shall be taken within thirty
(30) days after notice. The City Council shall act on the appeal within thirty
(30) days after its receipt.
The Chief of Police shall have the authority to revoke a discharge permit
issued hereunder upon application of the standards for issuance as herein
set forth.
