The provisions of this chapter may be enforced by the Town Harbormaster, Bay Constables, Town Police Department officers or other lawfully designated agents pursuant to their special duties.

Unless a different penalty is provided for in any section in this chapter, any violation of the provisions of this chapter shall be punishable as follows:
A. 
The first offense shall be punishable by a fine as set forth in the schedule of fines contained in this chapter, including additional penalties for failing to timely answer any instrument issued for the aforesaid conduct, or by imprisonment for up to 15 days, or both.
B. 
The second offense, within a period of 18 months, shall be punishable by a fine of not less than $250, nor more than $500, or by imprisonment for not more than 15 days, or both.
C. 
The third or subsequent offense, within a period of 18 months, shall be punishable by a fine of not less than $400, nor more than $1,000, or by imprisonment for not more than 15 days, or both.
D. 
Each continuing day of violation of this chapter shall constitute a separate offense.
E. 
In addition to the penalties defined herein, the Town of East Hampton may take any appropriate action or commence any proceeding to prevent the continued violation of any provision of this chapter.
F. 
Any person or entity found by the Bureau of Administrative Adjudication to have violated any of the provisions of § 246-7B, 246-9B to 246-10B(1), shall likewise be subject to a monetary penalty not to exceed the maximum fine amounts set forth in the instant chapter, for the respective violations referenced therein for a first offense, subsequent offenses and continuing offenses.

G. 
In addition to the penalties proscribed above, any person who violates any provision of § 246-18G or 246-19E shall be liable for a civil penalty not exceeding the actual costs of repairs or clean-up or any spill resulting from a violation of such provision.
