The governing body of Harford County, by resolution, may designate commercial, industrial and residential areas or a combination thereof as development districts for purposes as authorized in § 266JJ-1 et seq. of Article 41 of the Annotated Code of Maryland.
Prior to establishing development districts:
A. 
The County Executive, with the concurrence of the County Council, shall establish such administrative rules and regulations, policies and criteria necessary to implement the provisions of this Article.
B. 
The County Council and the County Executive shall take into consideration:
(1) 
The fiscal impact the proposed district will have on Harford County.
(2) 
The ability of the proposed district to be self-supporting.
(3) 
Capital improvement requirements, such as, but not limited to, water and sewer and highways.
(4) 
The impact the proposed district may have on the development envelope serviced by water and sewer.
(5) 
The overall impact the proposed district will have on the county.
(6) 
Any other matters deemed pertinent to a development district.
Any contiguous commercial or industrial business area or any contiguous residential area or combination thereof may be designated as a development district and shall be designated and established as follows:
A. 
Commercial/Industrial districts. By resolution, the county may designate a commercial or industrial development district, or commercial or industrial businesses may solicit the county to be designated as a development district.
B. 
Residential districts. The county may designate a contiguous residential area as a development district, or, by petition of a majority of residential property owners, the county may designate an area as a residential development district.
