A. 
It shall be unlawful for any person to construct, maintain, install or operate any private swimming pool which is not in compliance with the State Uniform Construction Code, N.J.A.C. 5:23-1 et seq., and the Township's land use regulations set forth in Chapter 215 of this Code.
B. 
A private swimming pool is deemed to include any "private bathing place" as that term is defined in N.J.A.C. 8:26-1.3.
C. 
Fees for the construction or alteration of a private swimming pool shall be as set forth in Chapter 172, Fees.
A. 
It shall be unlawful for any person to locate, construct, maintain or operate a public swimming pool without first securing a license therefor in accordance with the Swimming Pool Code of New Jersey, N.J.A.C. 8:26-1 et seq.
B. 
The location, construction, alteration and operation of public swimming pools in the Township are regulated by N.J.A.C. 8:26-1 et seq. (Public Recreational Bathing), the State Uniform Construction Code, N.J.A.C. 5:23-1 et seq. and the Township’s land use regulation set forth in Chapter 215 of the Code of the Township of Ewing. Copies of the foregoing codes and chapter are on file in the office of the Secretary of the Board of Health and the Municipal Clerk for the use and examination of the public.[1]

C. 
Applications for such a license shall be made to the Municipal Clerk and must have the approval of the Township Health Official for such licensing. If approved, an annual fee shall be paid to the Municipal Clerk as set forth in Chapter 172, Fees. Licenses issued for the operation of a public swimming pool shall expire annually on May 31 of each year, and application for renewal thereof shall be submitted together with the required fee prior to June 1 of each year.

Licenses required by this chapter may be denied or suspended by the Health Official for failure to comply with this chapter or the State Uniform Construction Code, N.J.A.C. 5:23-1 et seq., or the Swimming Pool Code of New Jersey, N.J.A.C. 8:26-1 et seq. The Health Official shall afford the person whose license to locate, construct, alter or operate has been denied or suspended an opportunity to be heard at a public hearing.
E. 
The term "swimming pool" as used in this section is intended to include the terms "recreational bathing place" and "public bathing place," as defined in N.J.A.C. 8:26-1.3.
A. 
This chapter shall be enforced by the Construction Official, Building Inspector, Health Official and any other appropriate enforcing agency of the Township.
B. 
The owner of any private swimming pool or public swimming pool shall allow the Construction Official, Building Inspector, the Health Official, Sanitary Officer or other duly authorized person access to the pool and appurtenances thereto for the purpose of monitoring and inspection to ascertain compliance with this chapter.
Except as provided herein, violations of this chapter shall be punishable as provided in Chapter 1, Article III, General Penalty.
