A. 
By authority of §§ 17.1-281 and 42.1-70 of the Code of Virginia, the following sums shall be assessed as part of the costs in the following types of actions in the Circuit Court, the General District Court and the Juvenile and Domestic Relations District Court:

B. 
In civil actions, the fees shall be collected upon the filing of the action; provided, however, no fees shall be collected in any action in which the commonwealth, a political subdivision or the federal government, is the party filing the action.
C. 
In criminal and traffic cases, the courthouse maintenance fee shall be collected when the defendant is:
(1) 
Charged with the violation of any statute or ordinance; and
(2) 
A finding of guilty or not innocent is made or the court directs that costs be paid.
D. 
All such fees collected shall be paid to the Treasurer of Rappahannock County to be distributed as directed by the Board of Supervisors.
A. 
Courthouse maintenance fee. The courthouse maintenance fee shall be held by the Treasurer subject to disbursement by the Board of Supervisors for the construction, renovation or maintenance of the courthouse or jail and court-related facilities and to defray increases in the cost of heating, cooling, electricity and ordinary maintenance.
B. 
Law library fee. The law library fee shall be held by the Treasurer subject to disbursement by the Board of Supervisors for the purposes set forth in § 42.1-70 of the Code of Virginia.
