Unless otherwise provided, the provisions of
this chapter shall be administered and enforced by the Building Inspector.
The Building Inspector shall keep a complete file of all applications,
permits, orders, certificates, requirements and decisions affecting
each and every application filed pursuant to this chapter.
Prior to the issuance of an excavation permit
or building permit in conjunction with any construction project or
prior to the change in use of any structure or parcel of land, a certificate
of zoning compliance shall be obtained from the office of the Building
Inspector. Said certificate shall be granted only if the application
complies with the zoning regulations of this chapter. Furthermore:
A. All applications for a certificate of zoning compliance
shall be in writing, signed by the property owner or his duly authorized
agent, on forms furnished by the Building Inspector and shall contain
the following information:
(1)
The nature and definite purpose of the building,
other structure or use;
(2)
A description of the property and all existing
and proposed structure(s);
(3)
A statement of any restrictions by deed or other
instrument of record; and
(4)
An agreement to comply with this chapter and
all other laws, ordinances and regulations that may be applicable.
B. Upon written request and application for a certificate
of zoning compliance by the property owner or his duly authorized
agent, the Building Inspector shall inspect any structure(s) or tract
of land existing on the effective date of this chapter and shall issue
a certificate of zoning compliance, certifying:
(1)
The use of the building, other structure or
tract of land; and
(2)
Whether such use conforms to all the provisions
of this chapter.
C. The Building Inspector shall make a determination
within 10 days after the application is received.
D. No certificate of zoning compliance shall be issued
if there are any pending violations of law or orders of the Building
Inspector, the Board of Appeals or the City Council.
E. A certificate of zoning compliance shall be issued
if the application is in full compliance with the provisions of this
chapter.

All persons engaging in new businesses within
the City after the effective date of this chapter and all persons
presently doing business within the City who change the location of
their business within the City after the effective date of this chapter
shall register the address of the business with the City Clerk/Treasurer
not less than seven days prior to the opening of the business or new
place of business to the public.
The Building Inspector is hereby empowered to
cause any use, structure or tract of land to be inspected and examined
and to order, in writing, the remediation of any condition found to
be in violation of any provisions of this chapter. After any such
order has been served, no work shall proceed on any structure(s) or
tract of land covered by such order, except to comply with such order.
The Building Inspector may cause the removal or discontinuation of
any use or structure which is determined to be a source of immediate
peril to persons or property or is a threat to public health or safety.
