A.
All license fees shall be due and payable on the first
day of January in each year. However, in the event that any new or
reopened business begins operation and makes application for a merchant's
license after July 1 of any given year, said business shall only be
required to pay 50% of the fee for such license.
B.
If any fee is not paid within 30 days of its due date,
a late fee surcharge of $25 will be assessed.

All licenses shall commence as of the first
day of January in each year and shall expire on the 31st day of December
next. Upon the transfer of location of a licensed business to a new
location within the Borough of Brooklawn or upon the sale of a going
business remaining in the borough, the license may be transferred,
provided that the annual license fee for the year has been paid and
a transfer fee of $5 is paid to the Borough Clerk.
A duplicate license may be issued by the Borough
Clerk to replace any license previously issued, which license has
been lost, stolen, defaced or destroyed without any willful conduct
on the part of the licensee, upon the filing by the licensee of an
affidavit sworn to before a notary public of the State of New Jersey
attesting to such fact and payment to the Borough Clerk of a fee of
$5.
No rebate or refund of any license fee or any
part thereof shall be made by reason of retirement of licensee from
business or by reason of nonuse of such license for all or any portion
of the license year or by reason of fire or other accident or other
casualty rendering the use of such license ineffective.
A.
Each license issued hereunder shall state upon its
face the following:

The name of the licensee and any other name under
which such business is to be conducted.
C.
The address of each business to be licensed.
D.
The amount of license fee therefor .
E.
The dates of issuance and expiration thereof.
F.
Such other information as the License Clerk shall
determine.
Every license under this chapter shall:
A.
Permit all reasonable inspections of his business.
B.
Permit access to the licensed premises at all reasonable
times by the License Clerk.
C.
Ascertain and at all times comply with all laws and
regulations applicable to such licensed business.
D.
Avoid all forbidden, improper, unlawful or unnecessary
practices, businesses or conditions which do or may affect the public
health, morals or welfare.
E.
Refrain from operating the licensed business on premises
after expiration of his license and during the period when his license
is revoked or suspended.
F.
Not loan, sell, give or assign to any other person
or allow any other person to use and display or to destroy, damage
or remove or to have in his possession, except as authorized by the
License Clerk or by law, any license or insignia which has been issued
to said licensee.

B.
In any instance where a business which would otherwise
be licensed separately hereunder is conducted in conjunction with
and as accessory to a principal business, a license fee shall be charged
only for the principal business, except for coin-operated vending
machines or slot machines. The following businesses are examples of
a business coming within the definition of "principal business": coliseum
club, tennis courts, swimming pool, ice-skating rink, restaurant.
C.
Cannabis
facility license fee.

In order to be granted a business license for the operation of any
state-licensed medical cannabis facility or recreational marijuana
facility within the Borough of Brooklawn, the following conditions,
along with all other requirements of the Borough Code, must be satisfied:
(a)
Completion of all forms, checklists, and other submissions as
may be required by the Borough Clerk's Office;
(b)
Payment of all applicable local fees, including inspection and
licensing fees, including a nonrefundable application fee of $5,000;
(c)
Demonstration that all applicable state licenses have been obtained;
(d)
Passage of all applicable state and local inspections required
to be completed prior to the beginning of operations and/or renewal
of any state and/or local license;
(e)
Emergency contact information to be utilized by police, fire,
and EMT personnel in the event of an on-site emergency; and
(f)
Submission of a full copy of the application for state licensure,
via hard copy or digitally, with pages prominently marked "confidential"
as appropriate for purposes of compliance with New Jersey's Open
Public Records Act.[2] (Note: Pages not marked as confidential will be disclosed
in response to an applicable OPRA request.)
