Full-time Borough employees shall receive the following benefits.

A holiday falling on a Saturday will be observed on the preceding Friday, and a holiday falling on a Sunday will be observed on the following Monday.
A. 
Full-time employees subject to the provisions of this section shall be entitled to annual vacation, which annual vacation shall be determined on an anniversary basis from commencement of the employment on the basis of the following schedule:
(1) 
One day for each full month of service during the first calendar year;
(2) 
One to four years of employment: 13 days;
(3) 
Five to nine years of employment: 15 days;
(4) 
Ten to 14 years of employment: 18 days;
(5) 
Fifteen to 19 years of employment: 22 days.
(6) 
Twenty to 29 years of employment: 31 days;
(7) 
Thirty years or more of employment: 32 days.
B. 
Full-time employees shall be required to take the annual vacation allotted to each full-time employee during the fiscal year; except for extenuating circumstances, a maximum of 10 days may be carried over with consent of the department head. Carried-over vacation must be taken during the first quarter of the succeeding year.
C. 
The director of each department shall annually arrange for a vacation schedule for each full-time employee of the department. The director shall file a vacation schedule with the Personnel Administrator. The director may alter the vacation schedule during the fiscal year, if necessary, for the efficient operation of the department. The director shall file the altered vacation schedule with the Personnel Administrator. An employee subject to the provisions of this chapter shall be entitled to credit for all full-time service in computing the years of service, if said service has been interrupted.
Full-time employees are entitled to four personal days off per year with pay after one full year of employment, provided that no employee shall take a personal day on the day before or the day after any vacation or any holiday as set forth in this chapter and further provided that the employee shall give 24 hours' notice prior to taking any personal day. Personal days are not cumulative and cannot be carried over to the next fiscal year.
A. 
Full-time employees are entitled to 15 working days of sick leave per calendar year. Part-time permanent employees shall receive prorated sick leave pursuant to the regulations set forth by the Department of Personnel. Sick leave is to be used only in cases where the employee is ill and unable to work, or in cases of the serious illness of a family member. Employees absent on sick leave for three or more consecutive working days must submit a doctor's verification of illness or injury to his/her supervisor before being allowed to return to work. After the tenth day of absence on sick leave in one calendar year, a doctor's verification must be submitted for all sick leave absences, regardless of duration. Prior to the return to work, the Borough of East Rutherford may require an employee to he examined by a physician designated by the Borough to verify fitness to return to normal duties. An employee will not be permitted to return to work until the verification is received.
B. 
School Marshals shall receive 10 sick days per year, not cumulative.
C. 
At the end of each calendar year, an employee's unused sick time is added to the allotment for the following year. Sick time for full-time employees is cumulative.
Employees are entitled to three consecutive calendar days' leave of absence for each death of an employee's immediate relative. "Immediate relative" includes spouse or significant other, child, parent, stepchild, sibling, grandparents, daughter-in-law, son-in-law, grandchildren, niece, nephew, uncle, aunt, or any person related by blood or marriage. Employees are paid for all working days during the bereavement leave.
A. 
When a full-time Borough employee is injured in the line of duty, the Mayor and Council may, in their discretion, pass a resolution giving the employee up to six months leave of absence with pay. When such action is taken, the employee shall not be charged any sick time for time lost due to such particular injury.
B. 
Prior to the passage of the resolution referred to in Subsection A hereof, a contract shall be executed between the employee and the Borough setting forth that the employee shall reimburse the Borough from monies he or she may receive as worker's compensation, temporary benefits or from possible legal settlement from or judgment against the person or persons responsible for the injury.
A. 
Leave without pay shall be granted to an employee only upon request. It shall be granted only when the employee has used his/her accumulated sick leave in the case of illness or his/her vacation leave if leave without pay is requested for reasons other than illness. Written request for leave without pay must be initiated by the employee, favorably endorsed by the department head and approved by the Mayor and Council before becoming effective. Such leave, except for military leave without pay, shall not be approved for a period longer than six months at one time. The Mayor and Council may extend such leave for an additional six months or any portion thereof.
B. 
A request for any type of leave except sick leave or death leave shall be made on a form prescribed by the Personnel Administrator. Such request, whenever possible, shall be made far enough in advance to permit approval, and at the same time, to permit coverage for the particular employment so that municipal services shall not suffer. In the case of sick leave, the employee shall notify his/her department head immediately if he/she is unable to report for work.
A. 
Employees who have been employed for at least 12 continuous months and have worked at least 1,000 base hours, excluding overtime, in the preceding twelve-month period, are eligible for family and medical leave with no loss of position or pay rate. However, employees on such leave will not continue to accrue vacation days, sick days, personal days or longevity. Employees taking family or medical leave under this section continue to be eligible for paid health insurance coverage under the Borough of East Rutherford policy.
B. 
Upon written notice, eligible employees are entitled to a family or medical leave for up to 12 weeks to care for a newly born or adopted child or a seriously ill immediate family member or for the employee's own serious health condition that makes the employee unable to perform the functions of the employee's position. Eligible employees who take leave under this policy must use all accrued available vacation and personal days during the leave. The use of accrued time will not extend the leave period. After exhausting accrued time, the employee will no longer be paid for the remainder of the leave.
C. 
The period of leave must be supported by a physician's certificate. An extension past 12 weeks can be requested, but medical verification of the need must be submitted prior to the expiration of the leave. The Borough of East Rutherford reserves the right to deny any request for extended leave. Additional information concerning the family leave policy and eligibility requirements are available from the Personnel Administrator.
A. 
Any full-time employee who is a member of the National Guard, Naval Militia, Air National Guard, or a reserve component of any United States armed force who is required to engage in field training will be granted a military leave of absence with pay for the training period as authorized by law. The paid leave will not be counted against any available vacation.
B. 
When an employee after one year's service with the Borough of East Rutherford is called to active duty or inducted into the United States military, the employee shall automatically be granted an indefinite leave of absence for the duration of military service. To be reinstated by the Borough of East Rutherford without loss of privileges or seniority, the employee must report for duty with the Borough within 60 days following release from active duty under honorable circumstances.
C. 
During the period of active military duty, the employee shall be paid the difference between military salary and the employee's regular salary for a period not to exceed 180 days. Employees on active service will also continue to receive paid health insurance coverage during the one-hundred-eighty-day period plus an additional 30 days. After this period has expired, employees may continue coverage for themselves or their dependents under the Borough of East Rutherford group plan by taking advantage of the COBRA provision. Members of the state-administered retirement systems (PERS and PFRS) will continue accruing service and salary credit in the system during the one-hundred-and-eighty-day period.
