This article shall be known as an "Ordinance to Regulate the Time of Day Construction May Occur in the Township of Maplewood."
As used in this article, the following terms shall have the meanings indicated:
PERSON
Firms, corporations or voluntary associations, as well as individuals, and is specifically intended to include as persons subject to the penalties of this article individuals in managerial or supervisory positions with firms, corporations or voluntary associations, which individuals have authorized the activity proscribed by this article, whether or not such managerial or supervisory personnel are physically located at the site upon which the work is being conducted.
The erection (including excavating), demolition, alteration or repair of any building or site improvement other than between the hours of 7:00 a.m. and 8:00 p.m. on weekdays and between the hours of 8:00 a.m. and 8:00 p.m. on Saturdays, Sundays and holidays as recognized by the United States Government shall be unlawful except in the case of urgent necessity in the interest of health and safety and protection and preservation of property, and then only with a permit from the Construction Official or Fire Official, which permit may be granted for a period not to exceed three days while the emergency continues, and except for municipal or public utility work to the municipal infrastructure.
Any person who shall violate the provisions of this article shall, upon conviction, be punished by a fine not to exceed $1,000 for each violation or by imprisonment in the county jail for a period not to exceed 90 days, or by both such fine and imprisonment for each violation of the provisions of this article. Each day the same is violated shall be deemed and taken to be a separate and distinct offense.
