As used in this Article, the following terms
shall have the meanings indicated:
PEDDLER
A person commonly referred to either as a "peddler" or "hawker,"
who goes from place to place or from house to house by traveling on
the streets and carries with him goods, wares and merchandise for
the purposes of selling and delivering them to consumers, or any person
who has goods, wares and merchandise of any description sent from
place to place or from house to house by traveling on the streets
for the purpose of selling and delivering them to consumers.
No person shall engage in business as a peddler
without having first obtained a license and paid the license fee.

A license is good only in the year in which it is issued. Persons obtaining a license after January 1 in any year shall pay the fee for the full year. License fees shall be as provided in Chapter
123, Fees.
In addition to the information required by Chapter
161, Licensing, §
161-2, an application for a peddler's license shall set forth the following:
A. The names and addresses of the persons from whom goods
making up the stock were or are to be purchased.
B. Three (3) business references.
C. The place or places of residence of the applicant
for the preceding three (3) years.
D. The length of time for which the license is desired.
E. If the applicant is an employee or representative
of any person, the application from the firm for which he purports
to work, authorizing the applicant to act as its representative.
The following additional regulations shall apply:
A. It shall be unlawful for any peddler to prosecute
his business of peddling or hawking by remaining in a fixed location
waiting for business within the boundaries of any street within the
township. This prohibition does not apply to the acts of selling,
delivering or transporting of merchandise within such streets.
B. It shall be unlawful for any peddler to misrepresent
the character or quality of merchandise offered for sale, to importune
or otherwise annoy any person for the purpose of effecting or inducing
a purchase or to conduct himself otherwise than honestly and courteously.
C. It shall be unlawful for any peddler to prosecute
his business on Sunday.
The fees for the license shall be imposed for
revenue and used for the general purposes of the township.
A license may be suspended for not more than
two (2) weeks by the issuing officer without hearing. In the case
of revocation of license, no part of the license fee paid shall be
returned.
In addition to the yearly license, the Township
Clerk may issue licenses to hawkers or peddlers for special occasions.
A. The manner of applying for and the method prescribed
for the issuing of the special license and for the evidence of its
having been issued shall be the same as prescribed and provided for
the yearly licenses.
B. The licenses for special occasions shall be effective
for a period not to exceed one (1) week or for such shorter period
as shall be designated by the Township Clerk in issuing the particular
license.
C. The fee for such license shall be as provided in Chapter
123, Fees, and shall be paid to the Township Clerk before the delivery of the license plate.

D. In the case of revocation of license, the license
fee paid under the provisions of this section shall be returned.
