This chapter shall be known and may be cited
as the "Administrative Code of Mullica Township, New Jersey" and is
herein referred to as the "revision."
The purpose of this chapter is to organize the
government of Mullica Township in accordance with the Township form
of government established pursuant to N.J.S.A. 40A:63-1 et seq., as
amended and supplemented, approved by the voters of Mullica Township
on May 9, 1995; to establish the administrative powers of the members
of the Committee and the Mayor; to establish and organize the various
departments of government; and to assign functions, powers and duties
to each department and to the personnel thereunder.
For the purpose of this revision and in the
interpretation and application of all other ordinances heretofore
or hereafter adopted, except as the context may otherwise require,
the following terms shall have the meanings indicated:
The Municipal Clerk duly appointed pursuant to law.
The ordinance enacting the Administrative Code of Mullica
Township.
The Mayor and Committee members of the Township of Mullica.
The County of Atlantic.
The calendar days.
An organizational unit of the Township government established
or designated by ordinance or this code as a department, together
with any agency or instrumentality of the Township government assigned
to such organizational unit by the Township Committee.
The administrative head of a department appointed in accordance
with this chapter or this code.
Any law or provision of law not inconsistent with N.J.S.A.
40A:63-1 et seq., as amended and supplemented, which is by its terms
applicable or available to all municipalities.
The Township Committee of Mullica Township.
The individual duly elected as Mayor of Mullica Township
pursuant to N.J.S.A. 40A:63-3 and possessing the powers of Township
Mayor as set forth in N.J.S.A. 40A:63-1 et seq. and this code.
A calendar month unless otherwise specifically provided.
Any act of local legislation heretofore or hereafter adopted,
and including this revision, so long as it shall have been adopted
by the procedure required for the adoption of an ordinance and so
long as it shall remain in force and effect pursuant to law.
Any individual, natural persons, partnerships, joint ventures,
societies, associations, clubs, trustees, trusts, corporations or
unincorporated groups; or any officers, agents, employees, servants,
factors or any kind of personal representatives of any thereof in
any capacity, acting either for himself or for any other person, under
either personal appointment or pursuant to law.
Goods and chattel, rights and credits, moneys and effects,
evidences of debt and all written instruments by which any right to,
interest in or lien or encumbrances upon, property or any debt or
financial obligation as created, acknowledged, evidenced, transferred,
discharged or defeated, in whole or in part, and every thing, except
real property as hereby defined, which may be the subject of ownership.
Any and every public ground, public square, public park or
other public place within the Township.
Includes lands, tenements and hereditaments, all rights thereto
and interest therein.
An action expressing the sense or will of the Township Committee
on a matter of special or temporary interest which shall be written
and may be adopted at the meeting at which it is introduced without
prior publication or hearing.
Mullica Township in Atlantic County, New Jersey.
Any elected or appointed official exercising duties and responsibilities
as defined in this code or in general law regarding the operation
of the Mullica Township government.
Seven days.
A calendar year unless otherwise specifically provided.
For the purpose of this revision and any other
ordinances heretofore or hereafter adopted, except as the context
may otherwise require:
A.
The present tense includes the past and future tenses
and the future, the present.
B.
The masculine gender includes the feminine and neuter.
C.
The singular number includes the plural and the plural,
the singular.
D.
"Shall" is mandatory, and "may" is permissive.
E.
The time within which an act is to be done shall be
computed by excluding the first and including the last day and, if
the last day be a Sunday or a legal holiday, that day shall be excluded.
F.
"Writing" and "written" shall include printing, typewriting
and any other mode of communication using paper or similar material
which is in general use, including facsimile transmissions, and legible
handwriting.
G.
"Chapter" shall mean one of the major divisions of
this code divided by subject matter.
H.
"Article" shall mean a major subdivision of a chapter
identified by a Roman numeral.
I.
"Section" shall mean a subdivision of an article.
In the event that this chapter conflicts with
any statute of this state, then the statute shall control.
