A code regulating premises on which swine are maintained, establishing
minimum standards governing the location and maintenance of such premises,
authorizing inspections of such premises, declaring and defining certain acts
or conditions on such premises as nuisances and declaring and fixing penalties
for violations thereof is hereby adopted pursuant to c. 188, P.L. 1950 (N.J.S.A.
26:3-69 to 26:3-69.6). A copy of said code is annexed hereto and made a part
hereof without inclusion of the text thereof herein.
The code established and adopted by this chapter is described and commonly
known as the "Maintenance of Swine Code of New Jersey (1957)."
Three copies of said Maintenance of Swine Code of New Jersey (1957)
have been placed on file in the office of the Secretary, Clerk or other similar
officer of this Board of Health upon the introduction of this chapter and
will remain on file in said office for use and examination by the public.
No person shall maintain more than four swine, as defined in said code,
on premises until a valid license or permit therefor shall have been issued
by the Board of Health, except that persons now maintaining swine as defined
by said code shall not be obliged to obtain a license or permit for one year
from the effective date of said code.

No garbage, offal or decaying vegetable substance shall be brought into
the Township of Mullica for the purpose of feeding the same to pigs.
Licenses or permits required by this chapter or the code may be denied
or suspended by this Board of Health for failure to comply with this chapter
or the code. This Board of Health shall afford the persons whose license or
permit to maintain swine on premises has been denied or suspended an opportunity
to be heard in public hearing and, following this, to be informed of the Board's
decision within two weeks thereafter.
The fee for a license or permit to maintain swine on premises shall
be $100.

Licenses or permits issued for the maintenance of swine on premises
shall expire annually on December 31 of each and every year, and the maximum
number of permits or licenses that shall be issued or be in effect in any
one given year shall not exceed four. Application for renewal thereof shall
be submitted together with the required fee prior to December 15 of each year.

Any person who violates or neglects to comply with any provision of
this chapter or the code established herein or notice issued pursuant thereto
shall, upon conviction thereof, be liable to a penalty of not less than $2
nor more than $100 for each violation or, in default thereof, shall be imprisoned
for a term not exceeding 90 days. Each day's continuance of such violation
shall constitute a separate offense, punishable by a like fine or penalty.
In the event that any section, sentence or clause of this chapter or
the code shall be declared unconstitutional or inconsistent with the provisions
of any statute governing the maintenance of swine, including those of c. 140,
P.L. 1957,[1] by a court of competent jurisdiction, such declaration shall not
in any manner prejudice the enforcement of the remaining provisions.

All persons who maintain swine as defined in said code under the provisions
of this chapter, shall contain such swine to an area, by fencing or otherwise,
wherein the outer boundaries of such area shall be at least 40 feet from a
contiguous neighboring property line and at least 200 feet from the nearest
dwelling house, commercial building, inhabited structure and public thoroughfare.

The issuance and renewal of licenses or permits for the maintenance of swine on premises within the Township of Mullica shall be in accordance with the regulations and provisions of the Atlantic County Board of Health, and fees for said licenses or permits shall be as established by the Atlantic County Board of Health, and penalties for violation of Chapter 255 of the Code of Mullica and/or ordinances and regulations of the Atlantic County Board of Health shall be as established by ordinance of the County of Atlantic.
