The Town Board of the Town of Brighton, which is a suburban town under the provisions of Article 3-A of the Town Law of the State of New York, takes cognizance of the fact that the Town of Brighton now maintains and operates an extensive Highway Department and Public Works Department. The orderly management of government requires the creation of the offices of Superintendent of Sewer Maintenance, Deputy Superintendent of Sewer Maintenance and Deputy Commissioner of Public Works in order to ensure the effective administration and efficient operation of the Highway Department and Public Works Department in the event of the absence or disability of the Superintendent of Sewer Maintenance and/or the Commissioner of Public Works.
A. 
There is hereby created the office of Superintendent of Sewer Maintenance of the Town of Brighton, Monroe County, New York.

B. 
There is hereby created the office of Deputy Commissioner of Public Works of the Town of Brighton, Monroe County, New York.
C. 
There is hereby created the office of Deputy Superintendent of Sewer Maintenance of the Town of Brighton, Monroe County, New York.

A. 
The Town Board shall appoint each department head and/or deputy department head, and the office of such department head and/or deputy department head shall be in the exempt class of the civil service.
B. 
Each department head and/or deputy department head shall hold office until the first day of January next succeeding the first biannual Town election held after his or her appointment and thereafter shall hold office for the term of two years and until his or her successor shall have qualified; provided, however, that the appointees to such offices shall be removable at the pleasure of the Town Board.
C. 
A vacancy in the office of a department head and/or deputy department head occurring other than by the expiration of term of office shall be filled only for the remainder of the unexpired term.
D. 
The Town Board shall fix the compensation, if any, to be received by each department head and/or deputy department head.

The Deputy Superintendent of Sewer Maintenance and the Deputy Commissioner of Public Works shall be the Acting Superintendent of Sewer Maintenance and/or the Acting Commissioner of Public Works and shall have all of the authority and duties of the Superintendent of Sewer Maintenance and/or the Commissioner of Public Works in the event of the absence or disability of or in the event of a vacancy in the office of the Superintendent of Sewer Maintenance and/or the Commissioner of Public Works.

Each department head and/or deputy department head shall, before entering upon the duties of the office, take and file with the Town Clerk an oath of office. The Town Board may require a department head and/or deputy department head to file a bond for the faithful performance of duties.
