As used in this Article IV of Chapter 73, the following terms shall have the meanings indicated:
FIRE PROTECTION SYSTEMS
Manual and automatic fire alarms, portable fire extinguishers, Type I commercial cooking hoods and fixed-pipe fire suppression systems including hoods, canopies, automatic fire sprinklers, alternative automatic fire-extinguishing systems and stand pipe systems.
MARSHAL
The Fire Marshal of the Town of Brighton.
TRADE
The trade of installing, charging, filling, maintaining, recharging, refilling, repairing and/or testing rechargable fire extinguishers, fire extinguishing systems, or fire protection systems.
No person shall engage in or conduct the trade within the Town of Brighton without first having obtained a license therefor issued by the Marshal or his designee, and without having first obtained and filed with the Marshal or his designee an insurance certificate, showing coverages as may be determined by the Marshal, consistent with the provisions of § 73-41. The Marshal or his designee may issue a license under this Chapter 73 to any applicant meeting the current licensing requirements of the National Institute for Certification in Engineering Technologies ("NICET") or holding a license to engage in the trade issued by the City of Rochester or holding any other license to engage in the trade issued by another jurisdiction which the Marshal determines has requirements for its issuance that are substantially similar to the licensing requirements of the City of Rochester or of NICET. The license issued by the Marshal shall expire on December 31 each calendar year, shall not be transferable and shall be limited in scope to allow only those disciplines included in the Trade that the licensee has demonstrated by the above referenced documentation it is qualified to perform.[1]

Editor's Note: Local Law No. 7-2014 provided that fees for permits issued under this chapter would be set by resolution of the Town Board, and that fees would be collected prior to the issuance of a permit. The Schedule of Fees is on file in the office of the Building Inspector and/or the office of the Fire Marshal.
A corporation or limited-liability company may conduct the trade within the Town of Brighton and shall be entitled to a license therefor, provided that one or more employees of such entity is the holder of a license duly granted as provided in this article. No person shall perform the trade on behalf of such entity unless he or she is licensed hereunder.
An insurance certificate showing coverages set by resolution of the Town Board and filed in the office of the Marshal shall be filed by every person or entity engaged in the trade within the Town of Brighton. Such insurance certificate shall name the Town of Brighton as an additional insured. Such insurance policy shall be renewed from year to year so long as the licensee engages in the trade within the Town of Brighton.
The Town Board may revoke any license issued under the authority of this chapter, provided that before such revocation, a public hearing shall be held before the Town Board, upon at least 10 days' written notice from the Marshal by first class mail to the licensee, and that following such public hearing, the Town Board determines that such licensee is not qualified to properly conduct the trade, or that the licensee's license from the City of Rochester or other licensing jurisdiction has been revoked or is otherwise no longer in effect, or that the licensee has violated the provisions of this article.
Persons convicted of violating any provision of this article shall be subject to the penalties contained in Chapter 1, General Provisions. Each day a violation continues shall constitute a separate offense hereunder.
