GENERAL REFERENCES
Vehicle and traffic regulations — See Ch. 216.
This chapter shall be known and referred to as the "Snowmobile Ordinance
of the Village of Canastota."
A.
For the purpose of this chapter, the definitions of words,
phrases and terms as set forth in § 21.05 of the Parks and Recreation
Law, as the same now exists or as the same shall hereafter be amended, are
herewith adopted and incorporated herein.
B.
Wherever herein the word "village" shall appear, it shall
be construed to refer to the Village of Canastota, a municipal corporation,
and to the territorial limits thereof as they presently exist or as they may
hereafter be duly extended.
Snowmobiles, duly registered, or exempt therefrom, by the Commissioner of Motor Vehicles of the State of New York, shall be permitted to operate upon and use, for the specifically limited purpose of gaining access to recreational areas, all of those certain streets and highways of this village as may hereafter be set forth in § 174-4 hereof, and such permission hereunder granted shall be subject to the rules, regulations, requirements and conditions in addition to those specified under Article 25 of the Parks and Recreation Law, as provided herein.
A.
All such village streets and highways as may be under the jurisdiction of the village are hereby designated as open to the use permitted and granted under § 174-3 except as follows: no exceptions.
B.
Such designation shall not in any way be construed to
mean that the village warrants the safety or the suitability of said streets
or highways for operation of or travel by snowmobiles.
A.
It shall be prohibited to operate any snowmobile hereunder
unless and except that said snowmobile be insured for liability to others
in the amounts of not less than $10,000 for each person, $20,000 for each
accident, and $5,000 for property damage.
B.
Written evidence of the foregoing insurance coverage
must be in the possession of the operator of any snowmobile operating under
the provisions of this chapter. Failure to present such evidence of insurance
coverage upon the request of any person empowered to enforce this chapter
shall be presumptive evidence that such snowmobile is not properly insured
as required in this section.
A.
No person shall operate a snowmobile on or across the
streets or highways of the village unless such person is 16 years of age or
over.
B.
No person 16 years of age or older, but under the age
of 18 years, shall operate a snowmobile on or across any of the streets of
highways of the village except between the hours of 6:00 a.m. and 6:00 p.m.
In addition to such rules and regulations as may now or hereafter apply
thereto under the provisions of the Parks and Recreation Law of the State
of New York, snowmobiles shall be operated hereunder in accordance with the
regulations, requirements and conditions hereinafter set forth and deemed
reasonable rules for the operation of such snowmobiles in this village and
promulgated herein to promote conservation of the local environment and the
safety of persons and property, to assure the proper use of snowmobiles for
recreation and commerce, while minimizing any detrimental effects of such
use, which regulations, requirements and conditions are as follows:
A.
No person shall operate a snowmobile on any of the streets
or highways of the village between the hour of 11:00 p.m. and the hour of
6:00 a.m. of the following day.
B.
No person shall operate a snowmobile on any of the streets
or highways of the village at a speed in excess of 15 miles per hour.
C.
No person shall operate a snowmobile on any of the sidewalks
or rights-of-way reserved for pedestrians, except to cross the same at approximately
right angles thereto, and during such crossings shall grant the right-of-way
to pedestrians.
D.
No person shall operate a snowmobile on any of the streets
or highways of the village other than on the extreme right-hand portion thereof,
except to pass parked vehicles.
E.
No person shall operate a snowmobile on any of the streets
or highways of the village after April 30 and before November 1 of each year.
F.
No person shall operate a snowmobile on any of the streets
or highways of the village in such manner as to cause unnecessary or unusual
noise disturbing to or interfering with the peace and quiet of other persons
or assemblages of persons.
G.
No person shall operate a snowmobile on any of the streets
or highways of the village while a member of a group of two or more snowmobiles
except in single file.
H.
No person shall operate a snowmobile through or into
any intersection of the streets and highways of the village with any other
street or highway of the village or with any other street, highway or roadway
without first bringing such snowmobile to a complete halt and granting the
right-of-way at such intersection to all pedestrian traffic at such intersection
and all vehicular traffic approaching such intersection so closely as to constitute
an immediate hazard during the time such operator is moving across or is within
said intersection.
I.
No person shall allow or permit the operation of a snowmobile
owned by him on or across any of the streets or highways of the village by
any person under the age of 16 years at any time or by a person under the
age of 18 years at any time after the hour of 6:00 p.m. of each day.
J.
In the interest of safety, the intersections of Chapel
Street, Wilson Avenue, Hickory Street and Rasbach Street with New York State
Route 13, also known as Peterboro Street are designated as crossing areas
for use by snowmobile operators in crossing said state highway. Such ordinances,
rules and regulations as may be a part of the Parks and Recreation Law and
Vehicle and Traffic Law of the State of New York, or may be adopted by any
of the municipalities chargeable with the responsibility therefor, shall apply
to New York State Route 13 within the village and to such other highways located
therein which are not legally considered village streets or highways.
Any law enforcement officer of the State of New York, the County of
Madison or this village and any other office duly designated as such and defined
under § 27.01 of the Parks and Recreation Law shall be empowered
to enforce the provisions therein.
A.
Any person who shall violate the provisions of § 174-5 of this chapter or the provisions of § 174-7I shall be guilty of an unclassified misdemeanor and shall be punished by a minimum fine of not less than $50 for the first offense and a fine of not less than $100 for each subsequent offense, and/or imprisonment of not more than 90 days.
B.
Any person who shall violate any other section shall
be guilty of a violation and shall be punished by a fine of not less than
$5 nor more than $100.
This chapter shall be in addition to the provisions of Article 25 of
the Parks and Recreation Law of the State of New York, and any provisions,
requirements or definitions thereof and amendments thereto shall be deemed
included herein and made a part of this chapter. Any section of this chapter
or part thereof which may be in conflict with Article 25 of the Parks and
Recreation Law which may be declared unconstitutional or invalid shall not
invalidate the remaining sections or parts thereof.
