As used in this chapter, the following terms shall have the meanings indicated:
SKATEBOARD
A single platform which is mounted on wheels, designed or used in fact for riding underfoot, having no mechanism or other device with which to steer or control the direction of movement thereof while being used.
Areas in the Village of Fultonville in which skateboard riding is prohibited are as follows:
A. 
All public sidewalks, roadways (including the entire paved and improved surface thereof, including curbs), parking lots, driveways and courtyards within the boundaries of the Village of Fultonville.
B. 
In, on or upon any publicly owned monument, sculptures or other statuary.
A. 
No person shall use or ride on a skateboard in or upon any of the areas and locations listed in § 113-2.
B. 
In all other areas within the Village of Fultonville, skateboard use is permitted so long as it is not effected in a manner that creates a risk of danger to any person or property or impedes or interferes with pedestrian or vehicular traffic.
C. 
Skateboards may be used in and upon the designated area within the park located on Washington Street. Those using the area for skateboarding shall ensure the safety of others using the park, shall not add any type of permanent fixtures to the area and shall use the area at their own risk.
A. 
Any police officer who shall observe any person using or riding upon a skateboard in violation of this chapter shall take possession of the skateboard and issue a dated written notice of such violation to such person or, if such person is under the age of 18 years, to the person and his or her parent or guardian, together with a copy of this chapter, and shall file a copy of such written notice with the Clerk of the Village Court.
B. 
For the first offense, the skateboard shall be returned to the rider upon his or her appearance, if 18 or older, in said Village Court. If the rider is under 18, it shall be returned upon the appearance of the rider and his or her parent or guardian in Village Court.
C. 
In the case of a second or third violation, the skateboard shall not be returned to the rider for 30 days from the date of the violation, and shall be returned at that time upon appearance of the rider in Village Court or, if the rider is under 18 years of age, upon the appearance of the rider and his or her parent or guardian in Village Court.
D. 
Upon a fourth or subsequent violation, the skateboard shall not be returned to the rider and shall be forfeited to the Village of Fultonville.
