Critical environmental areas will be designated from time to time by
resolution of the Council in accordance with provisions of Part 617.14.
A.
Type I actions shall be determined as follows: for purposes
of this chapter, Type I actions include all those given in Part 617.4.
B.
The Type I list promulgated in Part 617 may be enlarged
at the discretion of the Council. However, the enlarged Type I list may not
include any actions specifically listed as Type II in Part 617, and shall
be adopted in the form of an amendment to this chapter.
A.
Type II actions shall be determined as follows: for purposes
of this chapter, Type II actions include all those listed in Part 617.5.
B.
The Type II list promulgated in Part 617 may be enlarged
at the discretion of the Council. However, the enlarged Type II list may not
include any actions specifically listed as Type I in Part 617, must be in
conformance with the criteria contained in Part 617.5, and shall be adopted
in the form of an amendment to this chapter.
This chapter takes effect immediately after publication as required
by the City of Lackawanna Charter. A copy of this chapter must be filed with
the Commissioner of the Department of Environmental Conservation.
