This chapter shall be known and may be cited as the "Health and Sanitation Ordinance of the City of Lackawanna, New York."
No person shall permit or have any vegetable or animal matter, water or other liquid on his or her premises or grounds which shall give an offensive odor or be injurious to life or health.
No person shall permit any noxious or offensive liquid of any kind or nature, or any foul or filthy matter whatever, to drip, run or fall from or out of any building, vehicle, structure, yard or place into or upon any street or public place nor shall any person throw, deposit, place or leave any decaying vegetable or animal matter or any matter likely to decay or to become offensive or injurious to health upon any street, sidewalk or public place.

A. 
When any lot or any part thereof shall, from any cause whatsoever, become in whole or in part the repository of stagnant water, it shall be the duty of the owner, lessee or occupant, within a specified time given in a written notice by the Code Enforcement Officer, to cause such lot or part thereof to be filled with clean earth or other inoffensive substances.
B. 
No person, corporation, limited liability company, partnership, limited partnership, business trust, estate, trust, association or any other legal entity shall intentionally or willfully, by any means, cause water to flow onto the land of an adjoining landowner or adjoining property.
No person shall throw, deposit or leave upon any street or public place any dirt, brick or other material whatever so as to obstruct the free flow of water along any gutter or surface waterway.
No person shall spit upon the floor, steps or platform of any car or upon the floor of any public place, hall or building or upon the hallways, stairs or approaches thereto, or upon any sidewalk.
All dumpsters and similar large receptacles for rubbish and/or litter situated on business or commercial premises shall be enclosed with a suitable opaque fence or screening approved as to type, height, construction and location by the Chief Engineer.
