A. 
Required. A certificate of public safety will be required by all persons, corporations, partnerships, agencies, governmental bodies, etc., presently operating or proposing to build, establish or operate:
(1) 
Nursing homes.
(2) 
Rest homes.
(3) 
Medical clinics.
(4) 
Professional medical or dental buildings.
(5) 
Hospitals.
(6) 
Clinics.
(7) 
Treatment centers.
(8) 
Laboratories.
(9) 
Medical services agencies.
(10) 
Dispensaries.
(11) 
Therapeutic treatment centers.
B. 
Operation without certificate prohibited. No such places or facilities shall be operated in the City of Lackawanna without first obtaining a certificate.
A certificate of public safety shall be issued by the Director of Public Safety. No new certificates for new or proposed places or facilities as described in § 135-19A shall be issued until the Director shall have an opportunity to inspect, for compliance with this article. All preexisting medical or nursing facilities within the jurisdiction of the City of Lackawanna shall be required to obtain such certificate.
The Director of Public Safety shall call on, and use, the following persons and departments to give him or her technical assistance, advice and help in inspecting these places and facilities for compliance to safe standards in the areas enumerated and set forth in § 135-22.
A. 
Chief Engineer of the City of Lackawanna.
B. 
Chief of Police.
C. 
Chief of Fire Division.
D. 
Health Department.
E. 
Sanitation Department.
F. 
Sewage Treatment Division.
G. 
Department of Public Works.
H. 
Consulting engineers and experts, with approval of Council.
These aforementioned places and facilities shall be inspected for safety compliance in the following areas:
A. 
Structural.
B. 
Sanitation.
C. 
Fireproofing.
D. 
Safe occupancy (number of persons).
E. 
Waste disposal (solid and liquids).
F. 
Traffic engendered by the operation.
G. 
Electrical.
H. 
Safe storage of dangerous or potentially dangerous substances.
I. 
General health.
J. 
Proper safeguards for the protection of the community taking into mind and consideration the various dangerous or potentially dangerous or diseased persons or animals associated with the operation of the facility.
K. 
Access roads, sidewalks, portals, parking lots, ramps and the like.
A. 
Contents. Application for a new certificate of public safety shall be made to the Director of Public Safety, and such application shall be accompanied by a complete set of plans and specifications of the proposed facility together with a resume of the purposes of the facility and explanation of the manner in which the facility will be used and operated.
B. 
Fee. There shall be no fee charged by the City of Lackawanna for such certificate.
A. 
Inspection. The Director of Public Safety within one month after the completion of inspections under this article shall either issue a certificate of public safety or an order of noncompliance. Such order of noncompliance shall be filed in the City Clerk's office and the violator shall be notified of the violation by copy of the order sent by certified mail.
B. 
Certificate not to be unreasonably withheld. Such certificate shall not be unreasonably withheld by the Director of Public Safety but it shall be the sole discretion and judgment of said Director, based on all technical and professional help, reports, recommendations and assistance; whether said certificate shall be issued or not.
C. 
Preexisting facilities. Preexisting facilities will be given a reasonable time in which to come up to compliance, after notification of deficiency and such reasonable time shall be established by the Director of Public Safety and notification of such time shall be served in writing on the violator by the Director.
The certificate of public safety shall be good for a period of one year, and annual reinspections shall be conducted by the Director. However, any noncompliance coming to the attention of the Director at any time between inspections shall be corrected immediately or an order of noncompliance may be issued canceling the previously issued certificate.
A. 
Failure to comply with the order of deficiency issued by the Director of Public Safety within the time allowed or erection or construction of a facility without first obtaining a certificate as provided shall be classed as a violation punishable by a fine of $250. Every two-week period that a facility is in noncompliance shall constitute a separate violation.
B. 
In addition, noncompliance with the order of the Director of Public Safety for a period exceeding three months from the date of filing the order of noncompliance in the City Clerk's office will result in immediate prohibition of occupancy of the noncomplying place or facility.
