Subdivision of land — See Ch. 135.
There shall be a Planning Board for the Town of New Berlin, Chenango
County, New York, to be known as the "Town of New Berlin Planning Board,"
consisting of five members appointed according to the requirements of the
Town Law for terms of five years each. The Planning Board shall meet and elect
a Chairman, Vice Chairman and Secretary.
Pursuant to § 276 of the Town Law, said Planning Board is
hereby authorized and empowered to approve plats showing lots, blocks or sites,
with or without streets or highways, and to approve preliminary plats within
that part of the town outside the limits of any incorporated city or village
and to approve the development of plats already filed in the office of the
County Clerk if such plots are entirely or partially undeveloped.[1]
Said Town of New Berlin Planning Board is authorized and empowered to
require County Planning Board review of certain actions consistent with §§ 239-m
and 239-n of Article 12-B of the General Municipal Law.
Said Town of New Berlin Planning Board is authorized and empowered to
review the Comprehensive Plan and to recommend changes to the Town Board regarding
the future residential, commercial, industrial and agricultural areas within
said town and to disseminate information concerning such maps and plans to
the residents of the town, to conduct public hearings on such plans and maps
and to make recommendations to the Town Board of the Town of New Berlin relative
to adoption of local laws and statutes to implement such proposals, plans
and maps and to make application to said Town Board of the Town of New Berlin
for funding in order to carry out its functions in their entirety.
The Town Clerk is hereby directed to forthwith file a certified copy
of this chapter with the Chenango County Clerk.
