The Town Board of the Town of New Berlin recognizes
that it is desirable to hire employees who are residents of the Town.
The Town Board further recognizes that the most qualified candidates
may not always be residents of the Town of New Berlin. Therefore,
it is in the best interests of the Town of New Berlin that nonresidents
be permitted to work as employees of the Town of New Berlin in specific
appointed positions.
The authority for the Town Board of New Berlin
to appoint nonresidents as employees lies in § 10, Subdivision
1d(3), of the Municipal Home Rule Law.

The position of Town police officer may be filled by a resident
of the Town of New Berlin, or a resident of the County of Chenango
and adjoining counties.

The Highway Superintendent may be chosen among
residents and/or nonresidents of the Town of New Berlin. However,
the Highway Superintendent must be a full-time resident of the Town
of New Berlin during the entire term of that employment, with the
exception that a nonresident hired for the Highway Superintendent
position is granted a grace period not to exceed one year from the
commencement of said employment to secure full-time residence in the
Town of New Berlin.
