Abbottstown Borough shall join with East Berlin Borough in accordance with the Pennsylvania Intergovernmental Cooperation Act of July 12, 1979, No. 180 (53 P.S. § 481 et seq.)[1] in an Agreement, a copy of which is attached hereto and incorporated by reference.

The President of Borough Council and the Secretary of the Borough are hereby authorized and directed to execute said Agreement, in duplicate, on behalf of Abbottstown Borough, under the Borough Seal, and to take such other actions as may be necessary to carry out the purpose of this article in connection with the implementation of said Agreement.
As required by the Intergovernmental Cooperation Act, the following matters are specifically found and determined:
A. 
The conditions of the Agreement are as set forth in the proposed copy of said Agreement referred to in § 25-5, above.
B. 
The duration of the term of the Agreement begins upon the passage of the required ordinance by both Abbottstown Borough and East Berlin Borough, and the Agreement will terminate upon the failure of East Berlin Borough to gather enough funds and financing to complete the purchase of the building or the formation of a joint recreation commission and the transfer of the school building to said commission or the sale of the school building by East Berlin Borough as per the terms of the Agreement.
C. 
The purpose and objectives of the Agreement are for the municipalities to cooperate in the purchase of the East Berlin Elementary School, and then convert said structure into a recreation building/community services building for the use of the citizens of the participating municipalities.
D. 
The objectives of the agreement in regard to purchasing the Elementary School will be met by financing by the Borough of East Berlin and contributions from other municipalities within the general vicinity of the Borough of East Berlin where the school is located, and grants from the state and federal government.
E. 
Initially, the organizational structure to implement the Agreement will simply be the governing bodies of the municipalities taking part therein. Eventually, the municipalities will form a joint recreation commission which will then take over the ownership of the building, any debt service associated therewith, and any income therefrom. Each municipality will have equal representation on said commission.
F. 
The Agreement contemplates that the property shall be acquired in the name of the Borough of East Berlin, for purposes of financing by the Borough, and will eventually be transferred to the joint recreation commission when it is established. If the commission or a similar entity is not established and the structure is sold by the Borough of East Berlin, the municipalities who contributed to the purchase thereof will receive a share of the proceeds of sale in proportion to their contributions to the purchase.
