[HISTORY: Adopted by the Board of Supervisors of the Township of Tobyhanna 12-15-1997 by Ord. No. 392. Amendments noted where applicable.]
This chapter shall be known as the "Township of Tobyhanna Manager Ordinance."
Pursuant to the Act of May 1, 1933 (P.L. 103, No. 69), reenacted and amended November 9, 1995 (P.L. 350, No. 60), as amended,[1] the office of the Township Manager of Tobyhanna Township is hereby created.

The office of Township Manager of Tobyhanna Township is hereby created. The office of the Township Manager shall be filled by one person appointed to said office by a majority vote of the Board of Supervisors.

The person appointed to the Office of Township Manager shall be, at all times, subject to removal by majority vote of the Board of Supervisors.
The person appointed to the office of Township Manager shall, unless removed in accordance with § 20-4 above or unless said person resigns, serve until his/her successor is appointed and qualified. The Township Manager shall have no personal interest, direct or indirect, in contracts with the Township.
Before entering upon his/her duties, the Manager shall post bond with corporate surety to the Township in an amount as shall be determined by the Board of Supervisors, conditioned upon the faithful performance of his/her duties.
The compensation of the Township Manager shall be set by resolution of the Board of Supervisors and may be changed by resolution from time to time at the discretion of the Board of Supervisors.
In case of illness or absence of the Manager from the Township, the Board of Supervisors shall designate a qualified individual to perform temporarily the duties of the Manager during such absence or disability.
The Manager shall be chosen solely on the basis of his/her executive and administrative abilities with special reference to the duties of his/her office as herein outlined. The Manager need not be a resident of the Township or of the Commonwealth of Pennsylvania at the time of his/her appointment, but during the tenure of his/her office he/she may reside outside the Township only with the approval of the Board of Supervisors.

The Township Manager shall act as Chief Administrative Officer of the Township. The Township Manager reports to, and is subject to oversight from the Township Board of Supervisors, which is the policy-making body of the Township. The power and duties of the Township Manager shall include, but shall not be limited to, the following:
A. 
He/she shall supervise and be responsible for all functions and activities of all municipal departments.
B. 
The Township Manager is responsible for achieving and maintaining a reasonable level of work productivity from the Township's workforce, and is responsible for notifying the Board of Supervisors of any and all proposed disciplinary suspensions in excess of seven days, disciplinary demotions, and disciplinary dismissals of employees. The Township Manager shall have the authority to issue all disciplinary actions.

C. 
The Township Manager is responsible for instituting and maintaining lawful employment/hiring procedures within the Township, and is responsible for hiring candidates for department heads or supervisory positions of employment with the Township, and notifying the Board of Supervisors within seven days of hiring said positions. The Township Manager shall have the authority to terminate any and all positions within the Township. The Township Manager shall also have authority to hire candidates for positions within the Township.

D. 
The Manager is responsible for the Township's compliance with federal and state employment and personnel laws; is responsible for the implementation of Township policies relating to matters of employment, including but not limited to maintenance of the Township's official personnel files (basic, medical and other), including being responsible for the confidential securing of those files in accordance with applicable law.
E. 
The Township Manager is responsible for recommending the compensation payable to, and the benefit structure applicable to, all Township employees. The Board of Supervisors has final authority in regards to such compensation and benefits and shall, in the exercise of this authority, give reasonable weight to the recommendations of the Manager.
F. 
In regards to personnel matters the Township Manager shall be the chief public spokesperson of the Township, it being recognized that having a single, centralized individual performing such a role best enables the Township to comply with its legal obligations to the public and to its employees.
G. 
The Manager is empowered to recommend personnel policies, ordinances, and resolutions to the Board of Supervisors.
H. 
The Manager is empowered, so long as the costs for so doing are within the bounds of the Administrative budget, to send or permit employees to attend training opportunities.
I. 
The Township Manager is responsible for maintaining personnel costs within the parameters established by the budget, it being recognized that unexpected contingencies can occur which produce personnel costs which cannot be avoided and which reasonably may not have been anticipated in the budget.
J. 
The Manager has the authority and responsibility to plan and direct the work to be performed by the Township's workforce; to delegate aspects of that authority and responsibility to subordinate managers and supervisors; to make, to the Board of Supervisors, personnel-related recommendations (whether related to policy formation, legislation, or otherwise) and to decide and/or make recommendations regarding other basic critical matters relating to Township personnel management.
