A Board of Recreation Commissioners for the Borough is hereby established. The membership of the Board shall consist of seven persons who are citizens and residents of the Borough. They shall be appointed by the Mayor.

There shall be two alternate members appointed by the Mayor. Alternate members shall have the same qualifications as regular members.
A. 
Alternate members shall be designated at the time of appointment as "Alternate No. 1" and "Alternate No. 2."
B. 
The terms of alternate members shall be for five years, except that one of the alternate members initially appointed shall be appointed for a term of four years. Thereafter all appointments shall be for a term of five years.
C. 
Any vacancy occurring otherwise than by expiration of term shall be filled by the governing body for the unexpired term only.
D. 
Alternate members may participate in discussion of the proceedings but may not vote except in the absence of a regular member. No vote shall be delayed in order that a regular member may vote instead of an alternate member. If a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote.
E. 
No alternate member shall be permitted to act on any matter in which the alternate has, either directly or indirectly, any personal or financial interest.
F. 
An alternate member may, after public meeting if requested, be removed by the governing body for cause.

The Commissioners first appointed shall be appointed for the following terms: two for five years; two for four years; one for three years; one for two years; and one for one year. Thereafter, all appointments shall be for a term of five years and until his successor is appointed and shall have qualified.

A. 
All vacancies shall be filled for the unexpired term only.
B. 
The members of the Board shall receive no compensation for their services.
The Board may appoint a Secretary or Clerk, a Superintendent of Recreation, and such number of custodians, supervisors and assistants for the several playgrounds and recreation places under its control as it shall deem necessary, and fix and determine their respective salaries.
A. 
The Board shall have full control over all lands, playgrounds and recreation places acquired or leased under and pursuant to the provisions of N.J.S.A. 40:12-1 to 40:12-8, inclusive, as amended and supplemented.
B. 
The Board may adopt suitable rules, regulations and bylaws for the use of the facilities referred to in Subsection A of this section, and for the conduct of all persons while on or using the same.[1]

C. 
The custodians, supervisors and assistants appointed by the Board under § 6-5 shall, while on duty and for the purpose of preserving order and the observance of the rules, regulations and bylaws of the Board, have all the power and authority of police officers of the Borough.

A. 
Establishment. The Board of Recreation Commissioners shall establish controls and regulations for the use of public playgrounds, parks and recreation areas or places and limiting the hours of such use.
B. 
Method of adoption. Said controls and regulations promulgated by the Board of Recreation Commissioners, prior to being finally adopted shall be advertised in full, once, in a newspaper published and circulated in the Borough of Dumont, if there be one, and if not, in a newspaper printed in the county and circulated in the Borough together with a notice of time and place when and where the said controls and regulations will be considered and finally adopted. Said publication shall contain a provision that all persons interested shall be given an opportunity to be heard concerning said controls and regulations at the time and place stated in the publication.
C. 
Enforcement. This article and the controls and regulations of the Recreation Commission shall be enforced by the law enforcement officers of the Police Department of the Borough of Dumont, or by any person having the same power and authority under any statutory provision.
D. 
Penalty. Any person convicted of the violation of any duly adopted control and regulation of the Board of Recreation Commissioners shall be punished as provided in Chapter 1, Article II, General Penalty, of this Code.[1]

A. 
The Board, with the approval of the Mayor and Council, may acquire lands for public playgrounds and recreation places, by gift or purchase, and the Board shall from time to time select lands for public playgrounds and recreation places, and when deemed necessary or advisable by such Board, select lands for an approach or approaches by way of ingress thereto and egress therefrom of such size and dimensions as the Board shall think suitable, regard being had to the population of the neighborhood.
B. 
The Board shall cause surveys and maps to be made thereof, with the approval of the Mayor and Council, with a careful estimate, as nearly accurate as may be, of the probable costs of acquiring such lands, and a statement of the annual rental and duration of term, if it is proposed to lease the same, together with an estimate of the cost of preparing such lands and suitably equipping the same by the erection of buildings, stands, seats and other structures and apparatus for such playgrounds and recreation places.
C. 
Such surveys, maps and estimates shall be submitted to the Mayor and Council of the Borough, with a request that an appropriation be made for the purpose of acquiring or leasing such lands, as the case may be, and suitably preparing and equipping the same.
A. 
If the governing body of the Borough by resolution authorizes the acquisition of such lands and appropriates a sum for the purchase and equipment thereof, or authorizes the leasing thereof and appropriates a sum for the equipment thereof, the Board shall proceed to acquire the same by purchase, condemnation or lease, as the case may be, and suitably prepare and equip the same for a playground and recreation place, or approach thereto.
B. 
If the Board is unable to agree with the owner or owners as to the price and terms of purchase, or if by reason of any legal disability, or the absence of any owner or owners thereof, or for any other cause, an agreement for the purchase of such lands or any part thereof, or any rights or interests therein cannot be made, the Board may cause such lands or any rights or interests therein to be condemned and taken on behalf of the Borough, and the compensation to be made therefor shall be ascertained and paid or tendered in the manner provided in N.J.S.A. 20:3-1 et seq., and the amendments thereof and supplements thereto.
C. 
The Board may cause any lands so acquired to be laid out and improved as a public playground, recreation place or an approach thereto.
D. 
The title to all lands acquired or taken under the provisions of N.J.S.A. 40:12-1 to 40:12-8 shall vest in the Borough, and all leases of land for such purposes shall be in the name of the Borough.
A. 
In order to provide the funds, in whole or in part, necessary to improve, maintain and police the playgrounds or recreation places under its control, the Board of Recreation Commissioners may arrange and provide for the giving of outdoor exhibitions, concerts, games and contests, and may use and employ such playgrounds or recreation places for the purpose of giving thereon outdoor exhibitions, concerts, games and contests.
B. 
The Board may charge and collect a reasonable admission fee for each person entering such playground or recreation place during the time or times when the same is being used or employed for such purposes.[1]

A. 
The Board shall make an annual report on or before the first day of January and transmit the same to the Mayor and Council.
B. 
The annual report shall contain a comprehensive and detailed report covering operations, receipts, disbursements and expenditures for the full year.
