[Adopted by Ord. No. 1067 (Secs. 2-72 through 2-77 of the 1970 Revised Ordinances)]
The office of Borough Administrator of the Borough of Dumont is hereby created in accordance with the provisions of N.J.S.A. 40A:9-136 et seq.
A. 
Appointment. The Borough Administrator shall be appointed by the Mayor with the advice and consent of the Council.
B. 
Term. The term of the office of the Borough Administrator shall be at the pleasure of the Mayor and Council.
C. 
Absence or disability. During the absence or disability of the Borough Administrator, the Borough Council may, by resolution, appoint an officer or regular employee of the Borough to perform the duties of the Borough Administrator. Such absence or disability shall be limited to three months, after which time a vacancy shall be deemed to exist in said office unless the Council, in its discretion, finds that an extension of such time would be in the best interests of the Borough and increases such period of time by a duly adopted resolution.
D. 
Removal. The Administrator may be removed at any time by a two-thirds vote of the Council. The resolution of removal shall become effective three months after adoption. The Council may provide that the resolution shall have immediate effect; provided, however, that the Council shall cause to be paid to the Administrator forthwith any unpaid balance of salary and the salary for the next three calendar months following the adoption of the resolution of removal. If the Administrator commits an act in violation of law involving moral turpitude or the violation of any state laws pertaining to the performance of the official duties of said office, the Council may remove the Administrator from office by a two-thirds vote without the three months' notice or the three months' salary required by N.J.S.A.A 40A:9-138.
E. 
Vacancy. Any vacancy in said office shall be filled by appointment of the Mayor with the advice and consent of the Council. In the event that the Mayor fails to appoint or in the event that his appointment is not confirmed for a period of 30 days, then the Administrator shall be appointed by a majority vote of the Council.
The Borough Administrator shall receive such compensation as shall be prescribed from time to time by the Salary Ordinances of the Borough of Dumont.
The qualifications and requirements for appointment to the office of Borough Administrator shall be as follows:
A. 
The Borough Administrator shall be appointed on the basis of his executive and administrative abilities and qualifications with special regard to education, training and experience in government affairs and shall have, as a minimum, a bachelor's degree and at least five years of New Jersey municipal management experience. An M.P.A./M.B.A. may substitute for two years of experience.
B. 
The person appointed to the office of Borough Administrator need not be a resident of the Borough of Dumont.
C. 
No elected member of the governing body shall be appointed as Borough Administrator during the member's term of office nor within one year after the expiration of said term.
D. 
The Borough Administrator shall devote his entire time and effort to the performance of the duties and functions of the position of Administrator and shall not engage in any other occupation, enterprise or employment while employed by the Borough of Dumont, except as approved by the governing body.
E. 
The Borough Administrator shall not engage in any political activity nor make any financial or other contribution to any local political campaign, lobby effort or issue pending before the governing body; provided, however, that nothing contained herein shall be deemed to prohibit the Borough Administrator from appearing before another governmental body on behalf of the Borough of Dumont when authorized or directed so to do.
The Borough Administrator shall be the chief administrative officer of the Borough of Dumont under the general policy supervision of the Mayor and Council. The Administrator's duties shall include the development of rules and regulations for administrative procedures governing purchasing practices, operation of all departments, personnel management and general coordination of departments, offices, boards and agencies of the Borough, all for the purpose of increasing the effectiveness and efficiency of the Borough government and promoting its economic and responsive operation. The Administrator shall:
A. 
Supervise and direct the business activities of all Borough departments and recommend, develop, promulgate and implement, with the approval of the Mayor and Council, sound administrative, personnel and purchasing practices and procedures for all departments, offices and agencies of the Borough of Dumont.
B. 
Act as a liaison among the various municipal boards, agencies and departments of the Borough of Dumont and its professional advisors and be responsible for the coordination of interdepartmental operations, with the authority and duty to discuss with department Chairmen and department heads such matters as may be deemed necessary to the interests of the Borough of Dumont municipal government and to give direction as may be deemed proper under the circumstances, within statutory limitations.
C. 
Serve as the purchasing officer of the Borough of Dumont and shall purchase, in accordance with the provisions of the governing statutes and sound purchasing practices, all services, supplies and equipment for the various agencies, boards, departments and other offices of the Borough of Dumont. Prior approval of the department Chairman shall be obtained for individual purchases exceeding one $1,000. Purchases shall be made in accordance with applicable state statutes, rules and regulations and shall require approval of the Mayor and Council. For purchases made without prior approval of the department Chairman or the Mayor and Council, at least three quotations shall be solicited from manufacturers, firms or other dealers when the cost of the item purchased exceeds $250, and the purchase shall be made from the lowest responsible vendor when kind and quality of the items are equal. The Administrator shall keep an accurate account of all purchases and shall, from time to time or when directed, make a full written report to the Mayor and Council; issue rules and regulations governing the requisition and purchase of all Borough supplies and equipment, consistent with the provisions of this article; and, in accordance with the policies set down by the Mayor and Council, review and recommend all bills and vouchers for payment prior to final approval by the Mayor and Council.
D. 
Annually, after consultation with department heads and Borough agencies, collect all necessary data and prepare a proposed capital and operating budget for consideration by the Mayor and Council. Said proposed budget shall be accompanied by the proper supplemental material in support of the proposed budget appropriation with a comparison of prior years' expenditures and an analysis of the proposed expenditures, with recommendations regarding the feasibility thereof.
E. 
Draft an explanatory budget message, including a comparison of prior years' appropriations and expenditures and an analysis of the proposed expenditures.
F. 
Upon adoption of the budget, be responsible for its administration and for implementation of the work programs contained therein and maintain a continuing review and analysis of budget operations, work programs and costs of municipal services and shall, on a monthly basis or as directed so to do by the Mayor and Council, submit said review and analysis to the Mayor and Council.
G. 
Serve as the chief personnel officer of the Borough of Dumont and, as such, after prior approval of the appropriate Council liaison, hire and promote employees of the Borough of Dumont and, subsequent to satisfactory completion of the probationary period, advance said employee or employees to the next step. When it is deemed necessary or advisable for the betterment of the Borough of Dumont to suspend an employee or employees, the Administrator may, after prior approval of the department Council liaison, discharge any employee or employees. All employees covered by state statutes shall be promoted or discharged only in accordance with such statutes. Any action taken with respect to a department head shall be taken only after consultation with the Mayor and Council. The Borough Administrator shall report all actions taken under this subsection at the next regular meeting of the governing body.
H. 
Be responsible for the negotiation of collective bargaining contracts with agencies, organizations or associations representing Borough employees, subject to the approval of the governing body, and for the administration and enforcement of such contracts and personnel policies and practices of the Borough.
I. 
Research and prepare the necessary documentation for negotiation activities and participate with the Mayor and Council in the negotiations and recommend the use of outside sources when deemed advisable.
J. 
Attend all meetings of the Mayor and Council and other committees as directed by the Mayor and Council, with a right to take part in the discussions. The Administrator shall receive notice of all regular and special meetings of the Mayor and Council and all advisory committees and shall attend all such meetings, whether within or without the Borough of Dumont, as may be assigned, from time to time, by the Mayor and Council.
K. 
Prepare the workshop agenda for each meeting of the Mayor and Council and supply facts pertinent thereto and deliver the same to the Mayor and Council 48 hours in advance of the workshop.
L. 
Keep the Mayor and Council informed of all matters assigned to him or otherwise within his jurisdiction through periodic reports, either in writing or orally, as directed by the Mayor and Council.
M. 
Receive copies of all general and official correspondence addressed to the Mayor and Council and refer the same to the appropriate officer or department for disposition and reply.
N. 
Report to the Mayor and Council annually, at such time as the Mayor and Council may require, on the coverage, expiration date and premium of each surety bond and contract of insurance, the nature and terms of outstanding leases, the rent reserved by each and their respective expiration dates.
O. 
See that the provisions of all franchises, leases and privileges granted by the Borough of Dumont are complied with.
P. 
Recommend the employment of experts and consultants to perform work and render advice in connection with the operation of authorized work projects in the Borough of Dumont subject to approval by the Mayor and Council.
Q. 
Expedite the letting of contracts and supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Borough of Dumont officer or official by statute.
R. 
See that all money owed the Borough of Dumont is promptly paid and proper proceedings are taken for the security and collection of all Borough of Dumont claims.
S. 
Keep the Mayor and Council currently informed as to federal aid projects and state aid projects and any other aid programs for which the Borough of Dumont may qualify.
T. 
Act as liaison between the Borough of Dumont and the various county, state and federal agencies with respect to all applications for funds and/or services needed or required by the Borough of Dumont.
U. 
Research, apply for and supervise the implementation of funding grants from various sources for the improvement and development of the Borough's capital projects and for services to the Borough and its residents.
V. 
At the request of the Mayor and Council, investigate the actions, duties and responsibilities of any elected or appointed officials and the operations of any department of the Borough, submitting his report relating thereto to the governing body for such further action as it may deem advisable.
W. 
Perform such other administrative and ministerial duties and functions as may be assigned by the Mayor and Council.
The Borough Administrator shall have all those powers and duties specially set forth herein, other than those required by law to be exercised by the members of the governing body itself or by any other officer, board or body.
