As used in this chapter, the following terms shall have the meanings indicated:
BUILDING
Any structure having a roof and intended for the housing, enclosure, shelter or protection of persons, animals, property, process equipment, goods and materials of any kind and nature.
CONTRACTOR
A person, firm, partnership or corporation engaged in the business of furnishing materials or performing services for construction or landscaping.
LANDSCAPER
A contractor in the business of designing gardens, planting of trees and shrubs, installing sprinkler systems and cutting or trimming of grass and shrubs.
STRUCTURE
Any combination of materials to form a construction for use, occupancy, or ornamentation, whether installed on, above or below the surface of land or water, including any additions or improvements to dwellings or buildings of any type or description.
A. 
Every person, firm or corporation engaged in the business of constructing, erecting, altering, repairing, restoring, re-roofing, re-siding, moving or demolishing the whole or any part of structures or the appurtenances thereto or swimming pools, erecting or altering signs, or landscaping within the Borough of Dumont, shall be required, before commencing any work, to register with the Building Department.
B. 
The owner or occupant of a structure or premises shall not be required to register provided the work will be performed, completed and supervised by the owner or occupant.
A. 
Applications for registration shall be submitted to the Building Department upon forms furnished by the Building Department.
B. 
The application shall include:
(1) 
The name and address of the applicant. In the case of a firm, partnership or corporation, the name and address of the principal officer or member of said firm, corporation or partnership.
(2) 
The number of years the person, firm or corporation has been in business or in existence at the current location or any prior locations, including the address of such prior locations, if any.
(3) 
The class under which the applicant is to be registered.
The registration fee shall be $10 per calendar year and no part of said fee shall be prorated for any part of the year. Upon payment of the fee, the Building Department shall issue a registration certificate for the calendar year for which the application was filed.
For the purposes of this chapter, there shall be the following classes of registration:
A. 
General contractor. A contractor engaged in the construction of a structure from start to finish and the alteration, addition to or repair of any structure. The contractor shall be equipped to handle such work either by and through a business entity controlled by the contractor or appropriate subcontractors and, in the latter event, must be completely responsible for his subcontractor's work.
B. 
Contractor. A contractor engaged in the construction of a structure from start to finish and the alteration, addition to or repair of any structure. The contractor shall be equipped to perform such work personally or by and through a business entity controlled by the contractor.
C. 
Roofing and siding contractor. A contractor engaged in the applying of roofing and siding materials to existing or new structures.
D. 
Demolition contractor. A contractor engaged in the demolishing of any structure in whole or in part.
E. 
Moving contractor. A contractor engaged in the moving of any structure.
F. 
Sign or billboard contractor. A contractor engaged in the erection, alteration or maintenance of signs or billboards.
G. 
Miscellaneous contractor. A masonry and/or dry wall contractor and/or a contractor engaged in work of a special character, including but not limited to swimming pool construction, as determined by the Building Department.
H. 
Landscaper. A landscaping contractor engaged in the regular activities of landscaping or sprinkler installation, including landscaping design, as a primary occupation. This does not include casual employment by minors or family members.
Any contractor entering into a contract to perform work or performing work in the Borough of Dumont for which a permit is required shall be responsible for obtaining the appropriate permits prior to commencing any work.
A. 
A registration certificate may be revoked for the following reasons:
(1) 
Failure to obtain the requisite permits.
(2) 
Failure to comply with the provisions of the building code of the Borough of Dumont.
(3) 
Failure to comply with the Revised Ordinances of the Borough of Dumont relevant to the construction, erection, alteration, repair, restoration, re-siding, re-roofing, moving or demolition of any structure or swimming pool or sign or part thereof or any other work covered by this chapter.
B. 
In the event a contractor fails to comply with the foregoing section, the Building Department shall cause a notice of violation to be served upon the contractor or principal member or officer of any firm or corporation by delivering same personally or by mailing same, by certified mail, return receipt requested, to the known address of the contractor or to the owner of the structure upon which work is being performed.
C. 
In the event the contractor fails to correct the defects set forth in the notice within 10 days after receipt of said notice, the contractor's registration certificate shall be revoked.
Any person, firm or corporation whose registration has been revoked may reregister and have his or its name reentered upon the registration list upon filing with the Building Department a certificate approved by the building inspector to the effect that all violations for which the registration was revoked have been corrected or are nonexistent, and upon the payment of the fee prescribed by § 188-3 of this chapter.
The Building Inspector, Zoning Officer and/or Code Enforcement Official and the Dumont Police Department are each independently charged with the enforcement of all the provisions of this chapter.

Any person, firm or corporation required by this chapter to register as a contractor who violates its terms shall be subject to a fine of not less than $200 nor more than $1,000 or imprisonment for a period of 90 days, or both, in the discretion of the Judge of the Municipal Court of the Borough of Dumont.
