The purpose of this article is to establish regulations for the use of the outdoor athletic facilities located in the Borough of Dumont, County of Bergen And State of New Jersey, so as to protect public health and welfare, to protect the property owner's right of quite and peaceful enjoyment of the property, reasonable privacy, freedom from unreasonable and significant interference, and to prescribe penalties for failure to comply.
The provisions and requirements of this article shall apply to outdoor athletic facilities, including but not limited to baseball, basketball, hockey, soccer, football and all other facilities, located adjacent to private residences of the Borough of Dumont.
A. 
Any and all group or organization using the outdoor athletic facilities shall conduct a proposed sport activity only during the hours specified in this article.
B. 
The proposed sport activity shall be for a public purpose or in the interests of the community, and shall not create undue traffic problems or unreasonably interfere with or detract from the general public welfare.
C. 
The proposed sport activity shall not be detrimental to the public health, welfare and recreation, and shall not unreasonably interfere with the adjoining property owners' rights to enjoy their properties.
D. 
Any and all groups or organizations conducting a baseball game shall not begin a new inning after 9:45 p.m. For all other sports or activities, no new play shall be initiated after 9:55 p.m.
E. 
The lights of the outdoor athletic facilities shall be turned off by 10:00 p.m., except with expressed written permission of the Police Department and the Borough Administrator of the Borough of Dumont.
Any person, group or organization who violate any of the provisions of this article or who fail to comply with the terms and provisions of any permit issued pursuant to hereto shall, upon conviction, be subject to a fine not to exceed $500 for each violation, in the discretion of the Judge imposing the same.
The Borough Building Department and members of the Police Department are authorized by law to serve and execute process in the Municipal Court of the Borough to enforce the provisions of this article.
For the purposes of this article, any planting or removal as herein mentioned shall be accomplished in such a manner as is reasonably calculated to create the least possible obstruction or interference with the public right to use outdoor athletic facilities.
