A. 
Before consideration for a final subdivision plat, the subdivider shall have installed the improvements required under Article VI (§ 386-26 et seq.) of this chapter.
B. 
In lieu of the installation of said improvements, the Joint Land Use Board shall require the posting of adequate performance guarantees satisfactory to such Joint Land Use Board and to the Borough Council to assure the installation of the required improvements.
A. 
The final plat shall be submitted to the Borough Clerk for forwarding to the Borough Joint Land Use Board for final approval within three years from the date of preliminary approval. The Borough Clerk shall immediately notify the secretary of such Joint Land Use Board upon receipt of a final plat. The Joint Land Use Board shall act upon the final plat within 45 days after the date of submission for final approval to the Borough Clerk.
B. 
The original tracing, one translucent tracing cloth copy, two cloth prints, eight black on white prints and three copies of the application form for final approval shall be submitted to the secretary of the Borough Joint Land Use Board at least five days prior to the date of a regular Joint Land Use Board meeting. Unless the preliminary plat is approved without changes, the final plat shall have incorporated therein all changes or modifications required by the Joint Land Use Board.

The final plat shall be accompanied by a statement by the Borough engineer that he is in receipt of a map showing all utilities in exact location and elevation, identifying those portions already installed and those to be installed, and that the subdivider has complied with one or both of the following:
(1) 
Installed all improvements in accordance with the requirements of this chapter.
(2) 
Posted a performance guarantee with the Borough Clerk in sufficient amount to assure the completion of all required improvements.
No final plat shall be approved unless the applicant submits evidence of a title policy or certificate of an attorney that the applicant is the owner in fee of the property covered by the subdivision.
A. 
If the Borough Joint Land Use Board favorably refers a final plat to the governing body, the governing body shall take action not later than the second regular meeting following the referral, noting its action on the plat. The Mayor shall affix his signature thereto if said action is favorable.
B. 
Failure of the said Joint Land Use Board and governing body to act, within the allotted time or a mutually agreed upon extension, shall be deemed to be favorable approval, and the Borough Clerk shall issue a certificate to that effect.
A. 
Upon final approval, copies of the final plat shall be filed by the Borough Joint Land Use Board with the following:
(1) 
Borough Clerk.
(2) 
Borough Engineer.
(3) 
Building Inspector.
(4) 
Tax Assessor.
(5) 
County Planning Board (three copies).
(6) 
Official issuing certificates for approved lots.
B. 
The final plat, after final approval by the governing body, shall be filed by the subdivider with the county recording officer within 90 days from the date of such approval. If any final plat is not filed within this period, the approval shall expire.
C. 
No plat shall be accepted for filing by the county recording officer unless it has been duly approved by the governing body of the Borough and signed by the Mayor.
If any person shall be aggrieved by the action of the Borough Joint Land Use Board, appeal in writing to the governing body may be taken within 10 days after the date of the action of the Joint Land Use Board. A hearing thereon shall be had on notice to all parties in interest, who shall be afforded an opportunity to be heard. After such hearing, the governing body may affirm or reverse the action of the Joint Land Use Board by a recorded vote of a majority of the total members thereof. The findings and reasons for the disposition of the appeal shall be stated on the records of the governing body, and the applying party shall be given a copy.
