There is hereby established the Department of Public Works.
A. 
There is hereby established the office of Director of Public Works. The Director shall be a City officer appointed by the Mayor and confirmed by the City Council. The Director shall be a person qualified by experience and training to perform the duties of this Department.
B. 
There may be an Assistant Director of Public Works who shall be a City employee appointed by the Mayor. The Assistant Director shall be an engineer licensed by the state in professional engineering and land surveying and qualified by experience and training to perform the duties of this Department.
C. 
There shall be a City Engineer appointed and confirmed in the same manner as the Director. The City Engineer shall be an engineer licensed by the state in professional engineering and land surveying.
D. 
There may also be the position(s) of Assistant Municipal Engineer(s) who shall be a City employee(s) in the civil service qualified for appointment by the Department of Personnel of this state.
E. 
There shall be a Manager of the East Orange Golf Course who shall be a City employee qualified by experience and training to perform the duties required of the position. The manager shall also be an employee in the civil service qualified for appointment by the New Jersey Civil Services Commission as either a Golf Superintendent (Title Code 01924) or Golf Facilities Manager (Title Code 04588) unless otherwise provided by law or ordinance.
A. 
The Director of Public Works shall have the following duties:
(1) 
He shall administer, supervise and direct the personnel and functions of the Department as set forth in this article.
(2) 
He shall manage and supervise the maintenance of streets, municipally owned vehicles and equipment, sewers, parks, shade trees, refuse collection, traffic control devices and maintenance of public buildings and grounds.
(3) 
He shall coordinate and supervise City-wide traffic planning, construction of municipal projects and the development of plans and contracts for municipal improvements and capital planning within the City.
(4) 
He shall coordinate the development of plans for long-range municipal improvements in cooperation with the Mayor, City Council and public and private agencies.
B. 
The Assistant Director of Public Works shall have the following duties:
(1) 
He shall assist the Director in developing, planning, organizing and implementing the maintenance of streets, municipally owned vehicles and equipment, sewers, parks, shade trees, refuse collection, traffic control devices and maintenance of public buildings and grounds.
(2) 
He shall manage work operations and/or functional programs and has responsibility for employee evaluations for effectively recommending the hiring, firing, promoting, demoting and/or disciplining of employees.
(3) 
He shall prepare, inspect and approve plans and specifications, consult with general contractors on construction projects, supervise the use of equipment, prepare reports and maintain records and files.
(4) 
He shall perform any other duties as assigned and designated by the Director of Public Works.
C. 
The City Engineer and Assistant Municipal Engineer(s) shall perform those duties as assigned and designated by the Director of Public Works.
D. 
Any and all references to the "City Engineer" in the Code of the City of East Orange shall hereinafter be designated "Director of Public Works" unless otherwise provided by law or ordinance.
E. 
The manager of the East Orange Golf Course shall have the following duties:
(1) 
Supervise the operation, maintenance, repair, construction and cleaning of the East Orange Golf Course and its facilities.
(2) 
Supervise all employees within the Division of the East Orange Golf Course.
(3) 
Manage the collection and accounting for all fees generated at the East Orange Golf Course.
(4) 
Administer the golf course in a manner that reflects sound budgetary practices.
(5) 
Participate in the preparation of plans and specifications for the construction of any improvements to the golf course.
(6) 
Participate in periodically evaluating the programs of the division and determine the needs of the public relative to providing services at the golf course.
(7) 
Participate in the development and implementation of programs and activities aimed at meeting the needs of the community at the golf course.
(8) 
Implement programs developed by the Mayor and City Council designed to promote the use of the golf course.
(9) 
Coordinate with citizen groups interested in participating in programs and activities promulgated by the division or other City departments.
(10) 
Coordinate with other City departments for the use of resources of public and private agencies for programs and activities developed by the division or other City departments.
The Public Works Department shall have the following divisions:
A. 
Plans and Construction Division.
B. 
Streets and Drains Division.
C. 
Sanitation Division.
D. 
Traffic Engineering Division.
E. 
Administration and Clerical Division.
F. 
Shade Tree Division.
G. 
Garage Division.
H. 
Parks Maintenance Division.
I. 
Public Buildings and Grounds Division.
J. 
Division of the East Orange Golf Course.
A. 
The Plans and Construction Division shall be responsible for:
(1) 
The preparation of initial sketches and estimates and drafting of all plans, specifications and drawings for all contemplated public works undertaken by the City.
(2) 
Supervision of all public works undertaken by the City to assure completion pursuant to this Code, other approved City ordinances and contracts undertaken by the City.
(3) 
The responsibility of the Public Works Department under Subsection A(1) and (2) above shall be limited where:
(a) 
Such public works are within the jurisdiction of one of the boards, commissions or agencies of the City and other provisions have been made therefor; or
(b) 
The City Council has appropriated funds for consulting services whereupon the responsibility of the Director of Public Works shall be to assist in the preparation of an appropriate contract setting forth in full the scope of services to be performed and to determine on behalf of the City whether such contract is being performed in a proper and professional manner.
(4) 
The preparation of searches certifying to municipal improvement approved by ordinance, upon request therefor and payment of the fee provided by law.
(5) 
The preparation and maintenance of an Official Tax Map under the direction of a licensed land surveyor on behalf of the City, if such map is adopted pursuant to N.J.S.A. 40:55D-32 et seq., and noting of any changes therein due to transfers of title or subdivision approval, including report of any purported subdivision which does not comply with this Code or other ordinances of the City.
(6) 
The approval for payment of all vouchers of contractors or consultants and certifying to partial completion or full completion of any contract with the City which the Department has the responsibility of overseeing.
(7) 
Maintaining a house-numbering map and the assignment of new house numbers.
(8) 
Assisting various City departments in the coordination of architectural services, including preliminary discussions, City architect agreements and the preparation of plans and specifications for structures and facilities.
(9) 
The review of architectural submissions for the various departments in coordination with the Building Division.
(10) 
Serving as the Clerk of the Works for the construction of municipal structures and facilities.
B. 
The Streets and Drains Division shall:
(1) 
Maintain, clean, plow and remove snow and improve, in accordance with funds available to the Public Works Department, streets, bridges, walks, sidewalks, parking lots and other public areas owned by the City or for which the City is responsible pursuant to law.
(2) 
Review and approve (or disapprove), as provided by law, this Code and other ordinances of the City, any application for construction or use in any public area owned by the City as provided in Subsection B(1) above by any person or party other than the City.
(3) 
Maintain and repair all real property acquired by the City of East Orange through in rem foreclosure proceedings.
(4) 
Be responsible for the maintenance, repair, improvement and construction of storm drains and open river channels within the City. The City shall be responsible for the capital improvement and construction of the sanitary sewer system.
C. 
The Sanitation Division shall:
(1) 
Supervise the performance of the contract between the City and the scavenger responsible for collection and disposal of refuse.
(2) 
In conjunction with the public health officer and the Director of Property Maintenance and Revitalization, enforce codes and ordinances with respect to litter, refuse and improper disposition of refuse within the City by all persons.
(3) 
Conduct a continuing cleanup, paint-up and fix-up program.
(4) 
Advise City representatives on matters pertaining to any joint meeting in which the City participates for solid waste disposal.
D. 
The Traffic Engineering Division shall:
(1) 
Administer the provisions of Chapter 260, Vehicles and Traffic, and other traffic ordinances of the City, except to the extent that general enforcement thereof is vested in the Police Department, including traffic planning, programming and control, marking of streets, posting of signs, locating and maintaining meters and meter collections, assigning, maintaining and constructing traffic signals and recommending, from time to time, such amendments as may be indicated or required in the interest of public safety and convenience, and changing traffic patterns.
(2) 
Operate the municipal parking lots of the City.
(3) 
Recommend provisions for improving the handling and routing of traffic on municipally owned streets but also in conjunction with county and state and interstate highways, the Garden State Parkway and the East-West Freeway, including service roads, ramps and other parts of the foregoing systems.
(4) 
Review and advise on any proposed changes in public transportation affecting the City, including matters pending before the Public Utility Commission and Interstate Commerce Commission, and maintain a current map of all routes utilized by public conveyances within the City.
E. 
The Administrative and Clerical Division shall:
(1) 
Keep books and records on all permits relating to streets, sewers and other public facilities in its jurisdiction, report promptly to the Chief Financial Officer and Tax Collector on all money collected for such permits and arrange for deposit thereof through the City Treasurer as of the day of collection.
(2) 
Keep all other books and records of the Public Works Department.
F. 
The Shade Tree Division shall administer the provisions of § 51-193, Landscaping.
G. 
The Garage Division shall operate a City garage for the repair and maintenance of City-owned vehicles and equipment, subject to such further arrangements as the Director of Public Works shall enter into with any other City department or agency operating or utilizing City-owned vehicles and equipment.
H. 
The Parks Maintenance Division shall maintain all City-owned parks and swimming pools within those parks, as well as any other parks which the City is required to maintain by contract, agreement or by law.
I. 
The Public Buildings and Grounds Division shall:
(1) 
Operate and maintain public buildings owned by the City or for which the City has assumed responsibility, except where the same are under the direction and control of other departments or agencies of the City.
(2) 
Provide custodian and janitorial services through its own staff or by contract for all buildings under the direction and care of the Department.
J. 
The divisions hereinabove shall have the following additional duties:
(1) 
To represent the City in the changing of streetlighting supplied by the Public Service Electric and Gas Company.
(2) 
To perform such other engineering and technical services as may be required for the physical development of the City upon its own initiative or upon the request of the Mayor or City Council, and advise and recommend such programs, ordinances or regulations as may be necessary to assure the proper physical functioning of the City.
K. 
The divisions shall be supervised by a Division Manager under the direction of the Director of Public Works. The Division Managers shall be City employees in the classified civil service qualified for appointment by the Civil Service Commission of this state.
(1) 
The Plans and Construction Division shall be supervised by a Project Coordinator, Construction.
(2) 
The Street Division shall be supervised by a Street Superintendent.
(3) 
The Sewer Division shall be supervised by a Sewer Superintendent.
(4) 
The Sanitation Division shall be supervised by a Sanitation Superintendent.
(5) 
The Traffic Engineering Division shall be supervised by a Traffic Engineer.
(6) 
The Administration and Clerical Division shall be supervised by a Chief Clerk, Engineering.
(7) 
The Shade Tree Division shall be supervised by a Tree Superintendent.
(8) 
The Garage Division shall be supervised by a Garage Superintendent.
(9) 
The Parks Maintenance Division shall be supervised by a Recreation Maintenance Superintendent.
(10) 
The Public Buildings and Grounds Division shall be supervised by a Buildings Superintendent.
L. 
This Department shall have additional personnel as may be provided for by the budget and set forth in the Salary Ordinance of the City. Said personnel shall be qualified by experience and training to perform the duties assigned by the Director.
M. 
The Division of the East Orange Golf Course shall:
(1) 
Be responsible for the development and implementation of golfing and other community-oriented activities and programs at the East Orange Golf Course.
(2) 
Be responsible for the sound and fiscally responsible management and operation of the East Orange Golf Course.
(3) 
Charge the following fees in connection with the East Orange Golf Course:

(a) 
East Orange residents/employees receive a 25% discount on season passes.
(b) 
All season passes are through tee times.
(c) 
All season pass holders must pay the nine-hole cart fee for the use of carts.
(d) 
League membership must be pre-approved by the submission of an application prepared by the golf course manager of the City of East Orange for up to 40 golfers whose names must be submitted with the original application, along with a fee of $8,780. For each additional golfer over 40 in number, there shall be an additional charge of $210.
(e) 
Tournament fees. There must be a minimum of 80 players. The cost per player, which includes a golf cart, is $60 per player, Memorial Day through Labor Day, and $40 per player after Labor Day. Also, a nonrefundable deposit of $500 is required to schedule and book the date.
(f) 
Upon the consent of the Department of Public Works (DPW) Director and City Administrator, the East Orange Golf Course Superintendent may reduce green fees to run special promotions or events for the East Orange Golf Course.
Neither the Director of Public Works nor his personnel shall participate in behalf of any private person for compensation in the preparation of any plan, drawing, survey or otherwise on any matter which is subject to approval by the Public Works Department or shall be subject to any hearing before any board, commission or agency of the City. Any other work performed within the City for any private person shall not be undertaken without the express permission of the Director, and then only if the same shall not constitute a conflict of interest with the responsibilities of the Department.
