As used in this chapter, the following terms shall have the meanings indicated:
ANIMALS
Includes cats, dogs, horses, any fowl or birds and any living creatures within the jurisdiction of the park or recreation area.
APPROVING GOVERNING AGENCY
The Board of Recreation Commissioners or its designee for municipality-owned property under the jurisdiction of Commissioners and the Borough governing body or its designee for all other municipality-owned property.

BOROUGH
The Borough of Hopatcong and, where appropriate, the governing body of the Borough of Hopatcong.

BOROUGH SPONSORED YOUTH PROGRAM
Any program sponsored by the Borough of Hopatcong conducting a youth program.

COMMISSION
The Board of Recreation Commissioners of the Borough of Hopatcong.

CRIMINAL HISTORY RECORD BACKGROUND CHECK
A determination as authorized by N.J.S.A. 15A:3A-1 to determine whether a person has a criminal record by cross-referencing that person's name and fingerprints with those on file with the Federal Bureau of Investigation, Identification Division and/or the New Jersey State Bureau of Identification in the Division of State Police.

CROSSING
Any crossing whether marked by a pavement or otherwise; the extension of any sidewalk space across any intersecting drive, street or highway.
CURB
Any boundary of any street, road, avenue, boulevard or drive, whether or not marked by a curbstone.
DIRECTOR
The Recreation Activities Coordinator or the Chairman of the Board of Recreation Commissioners if the position of Recreation Activities Coordinator is vacant.

NONSPONSORED YOUTH PROGRAM
Any youth program not sponsored by the Borough of Hopatcong who uses municipal property or facilities.

PARK ATTENDANT
Any person employed by the Commission or Borough as a parks attendant to perform duties or tasks within the park and recreation areas.
PARKS AND RECREATION AREAS
Any municipally owned property designated by the Mayor and Council of the Borough of Hopatcong to be governed by this chapter, including, but not limited to, Modick Park, Maxim Glen Park, Civic Center Park, Jefferson Trail Park, Thompson Park, and Sharp’s Rock Park.

PATH
Any footpath, walk or any path maintained for pedestrians.
PEDESTRIAN
A person afoot.
PERMIT
Any written license issued by or under the authority of the approving governing agency permitting a special event or activity on park facilities.
PERSON
Any natural person, corporation, company, association, joint-stock association, firm or copartnership.
RECREATION PERMIT
Any written license issued by or under the authority of the approving governing agency permitting a special event or activity on property within the municipal jurisdiction of the Recreation Commission.

SOLICITING
Persons selling goods or services by sample or taking orders for future delivery with or without accepting advance payment for the goods; persons seeking any form of contributions.
SPECIAL USE PERMIT
Any written license issued by or under the authority of the governing body permitting a special event or activity on municipal property.

STOPPING or STANDING
When prohibited, any cessation of movement of a vehicle, occupied or not, except when necessary to avoid conflict with other traffic, including horses.
TRAFFIC
Pedestrians, ridden or herded animals or vehicles, either singly or together, while in the confines of the parks' jurisdiction.
VEHICLE
Any conveyance (except baby carriages), including motor vehicles, trailers of all types, campers. tricycles, bicycles, sleds, sleighs, pushcarts, boats or vehicles propelled by other than muscular power; also, any horse.
VENDING
To sell, to dispose of by sale or to trade.
YOUTH PROGRAM
Any program that allows for participation in activities by those persons under 18 years of age. Activities may include but are not limited to sporting activities, passive recreation groups, clubs or camps and trips or other activities whereby some control and responsibility for children is assigned to some person other than a parent or caregiver.
