A. No changes shall be made to the contour of the land and no grading, filling, excavating or removal or destruction of topsoil or vegetative cover of the land shall be commenced until such time as an approval set forth in §
197-5B has been received.
B. For all projects disturbing more that 5,000 square
feet, the applicant shall file an application for soil erosion and
sediment control plan approval from the Sussex County Soil Conservation
District. For all projects disturbing less than 5000 square feet,
the applicant shall file five copies of a lot grading plan with the
Borough Engineer. The Borough Engineer may waive, in his discretion,
in writing, the need for a lot grading plan for projects which disturb
less than 1,500 square feet.
C. A separate plan required by §
197-5B shall be required for each separate existing or proposed lot.
The following activities are specifically exempt
from this chapter:
A. Land disturbances directly associated with additions
to or alterations of existing single-family dwellings.
B. Use of land for gardening primarily for home consumption.
C. Agricultural use of lands when operated in accordance
with a farm conservation plan approved by the local soil conservation
district.
D. Land disturbances of less than 1,500 square feet on
lots with existing single-family dwellings.
