Any person, corporation, partnership or business
entity who or which issues or passes a check, draft or similar sight
order for the payment of money to the Township of Mantua, which instrument
is not honored for whatever reason by the bank, savings and loan institution
or other entity upon which such check, draft or sight order is drawn,
shall be required to pay to the Township of Mantua a fee of $25 for
each such dishonored check to cover the administrative and banking
expenses of the Township for such dishonored check. This fee shall
be imposed regardless of whether the person, corporation, partnership
or business entity subsequently submits full payment for the amount
of the original check, draft or sight order.
The fee set forth herein shall be considered
a civil penalty under the law and shall not be considered criminal
in nature.

A.
In the event that the fee is not paid as required
herein, then one of the following shall occur:
(1)
The license, permit or approval toward which the dishonored
check was paid may be revoked or suspended by the Township Clerk;
(2)
In the event that such license, permit or approval
cannot be revoked or suspended by law, then the fee required herein
may be entered as a judgment or lien against said person, corporation,
partnership or business entity; and
(3)
If the dishonored check, draft or sight order was
paid towards any tax due, then the fee required herein may be added
to and collected as part of the tax due from said person, corporation,
partnership or business entity.
B.
The procedures otherwise set forth in Subsection A(1), (2) and (3) both shall not in any way limit the power of the Township of Mantua to proceed for payment of the fee provided for herein by any means otherwise authorized by law and in particular in accordance with N.J.S.A. 40:5-18, Subdivisions a through d.
