As used in this chapter the following terms
shall have the meanings indicated:
Any vehicle that is, or is capable of, being propelled or
drawn on land or water by an engine or motor.
No motor vehicles shall be sold in the Township
of Mantua, in any zone or on any property within any zone except under
the following terms and conditions:
A.
No more than two motor vehicles per year may be sold
from any property within the Township.
B.
No more than one motor vehicle shall be offered for
sale at any time.
C.
Any motor vehicle offered for sale must be titled
and shall be the property of the owner of the lands and premises from
which the motor vehicle sale is sought to be made.
D.
Proof of title shall be required to be shown to the
Code Enforcement Officer upon request concerning the motor vehicle
being offered for sale.
E.
No motor vehicle shall be offered for sale longer
than 60 days on any given property or lot.
F.
No motor vehicle shall be placed for sale in the front
yard area except on a driveway surface and when such motor vehicle
is so situated so as to not obstruct the sight triangle necessary
for safe access and egress to and from the property.
G.
No motor vehicle shall be placed for sale so as to
impair the vision from any intersection or street.
H.
No motor vehicle shall be offered for sale unless
it shall be within the setbacks of the zone in which the sale is being
offered.
I.
No signs shall be permitted except in or on the motor
vehicle offered for sale. No independent sign shall be permitted offering
any motor vehicle for sale.
J.
No permit from the municipality shall be required
to sell motor vehicles in accordance with this chapter.
K.
Unless otherwise required by state law, no additional
permits are required for sale of motor vehicles within the Township
of Mantua.
L.
The provisions of this chapter dealing with the limitation
on sales of motor vehicles within the Township of Mantua shall be
exempt to those properties licensed for the sale of motor vehicles
or which contain an active, permitted or conditional use on the property
which is a use customarily associated with the sale of used motor
vehicles.
A.
Any person, entity or corporation who or which violates
any provision of this chapter shall, upon conviction thereof, be punishable
by one or more of the following: imprisonment in the county jail or
any place provided by the municipality for the detention of prisoners
for a term up to but not exceeding 90 days or by a fine of not less
than $50 and not more than $2,000 or by a period of community service
up to but not exceeding 90 days, or any combination of the above.
B.
Each day that a violation exists, occurs or continues
shall constitute a separate offense for the purpose of imposing the
penalties referred to above.
