City of Rahway, NJ Chapter 109 Accommodations: Registration of Guests

§ 109-1 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:

ACCOMMODATIONS

Includes tourist camps, tourist cabins, trailer camps, tourist homes, rooming houses, lodging houses, boardinghouses, inns, motels or hotels, where sleeping facilities are furnished for pay to tourists, transients or travelers, whether or not meals are served to said persons.

§ 109-2 Register to be maintained; contents.

Any person engaged in the business of maintaining accommodations, as defined in § 109-1, shall keep and maintain a bound register in which shall be inscribed the following information:

A. The true name and address of each guest renting or occupying any part of said accommodation.

B. The signature of the person renting the accommodation.

C. Opposite each inscribed name, the proprietor or his agent shall state:

(1) The date and time of day of registration.

(2) The number of the room or other identification of the space rented.

(3) The state motor vehicle license number of the vehicle used by the registrant.

(4) The date and time of day each guest quits and surrenders his respective occupancy.

§ 109-3 Reports to police.

The proprietor or his agent shall report, in writing, the following information to the Chief of Police:

A. Within 54 hours of an original registration, the names of all persons who have occupied any portion of the accommodations for a longer period than 48 hours after registration.

B. Immediately upon the expiration of a fifteen-day period, the names of all persons who have registered and occupied any portion of the accommodations upon three separate occasions within said fifteen-day period.

§ 109-4 Inspections; availability of records.

A. It shall be the duty of any member of the Police Department to inspect such places of accommodations from time to time at any hour of the day or night in order to enforce the provisions of this chapter.

B. The register, required to be maintained pursuant to § 109-2, shall be available for inspection to all duly authorized peace officers upon their request.

§ 109-5 Exceptions.

Nothing in this chapter shall be construed in any way to apply to any duly licensed hotel or motel having more than 10 sleeping rooms for guests.

§ 109-6 Violations and penalties.

Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both.
