Pursuant to N.J.S.A. 40:67-1 et seq. and the amendments thereof and supplements thereto, the Council may, by ordinance, vacate any public street, highway, lane or alley, or any part thereof, including the vacation of any portion of any public street, highway, lane or alley measured from a horizontal plane a specified distance above or below its surface and continuing upward or downward, as the case may be, when such vacation is in the interest of the general public.

A. 
All applications for the vacations of any street, highway, lane, alley or public place in the City shall be made in writing to the Business Administrator of the City.
B. 
Each written application shall be accompanied by a deposit of $250 and an escrow deposit of $1,000 for the purpose of reimbursing the City for the outlay of funds which may be required for:
(1) 
Advertising costs.
(2) 
Engineering search costs.
(3) 
Ordinance drafting.
(4) 
Duplication expenses.
(5) 
Other expenses incidental to the processing of an ordinance authorizing such vacation pursuant to said application.
C. 
Upon completion of said street vacation, any monies not used from the escrow deposit shall be returned to applicant upon applicant's request in writing therefor.
