As used in this article, the following terms shall have the meanings indicated:
GARBAGE AND TRASH
Any refuse, rubbish, ashes, debris, garbage, construction waste, trash, automobile parts and tires, motor vehicles, grass, leaves, decay or other vegetative substances, and any other unwanted or discarded materials.
A. 
No person shall dump, dispose of or accumulate any garbage or trash in any location in the Township.
B. 
No person shall establish, maintain or permit the establishment or maintenance of any area, place or location for the dumping, disposal or accumulation of garbage and trash.
The use of any area, place or location for the dumping, disposal or accumulation of garbage and trash is hereby deemed and declared to be a detriment to the public health, safety, and welfare, a public nuisance and unlawful.

Any person who violates or fails to comply with any provision of this article shall be subject to the following penalties:
A. 
A fine of not more than $1,250, provided that the minimum mandatory fine for a first offense under this article shall be $250; the minimum mandatory penalty for a second offense under this article shall be $500; and the minimum mandatory fine for a third or subsequent offense under this article shall be $1,250; or
B. 
Imprisonment for a term of not more than 90 days or community service in the Township's recycling program for a period of not more than 90 days; or
C. 
Both a fine and imprisonment or, as an alternative to imprisonment, community service.
The Code Enforcement Officer of the Township shall be the official responsible for the enforcement of this article, concurrently with the Wall Township Police Department.
