No person shall deposit any brush, trees, tree limbs, ashes, cans, rubbish
or refuse of any kind whatsoever in Tannery Brook, Cazenovia Creek, or any
natural waterway, open surface water drain, open water impounding area or
pond within the Village of East Aurora or along the banks thereof in such
a way that such material might be blown, washed or otherwise deposited into
such brook, creek, waterway, drain, impounding area or pond.

No structure of any kind, including pipes or culverts therein or logs,
poles or timbers to serve as bridges, or for any other purpose, shall be built,
laid or maintained in or over Tannery Brook, Cazenovia Creek, or other natural
waterways within the Village of East Aurora without first obtaining a permit
from the Code Enforcement Officer therefor. No such permit for a bridge or
similar structure over such waterway shall be granted unless the lowest point
of the proposed bridge or similar structure is at least 18 inches above the
anticipated high-water mark of the brook, creek, or waterway at the site of
the proposed structure. Said anticipated high-water mark shall be determined
by an engineer approved by the Village. No bridge or similar structure shall
have supports between the banks of the stream. The granting or denial of such
a permit shall be subject to review by the Zoning Board of Appeals. The granting
of any such permit shall not impose any liability or place any responsibility
on the Village for any injury or damage caused by such structure.

The fee for a permit issued pursuant to §
266-2 shall be as provided for in Chapter
137, Article
II, of this Code.

Violations of any of the provisions of this chapter shall be punishable
by a fine of not more than $250 or by imprisonment for not more than 15 days,
or both. Each day's continuance of a violation after notice shall be
deemed a separate and distinct violation and shall be punishable accordingly.
