PM-100.1 Title: These regulations shall be known as the "Property Maintenance
Code of the City of Lockport, State of New York," hereinafter referred to
as the "Property Maintenance Code" or "this code."

PM-109.2 Penalty. Any person, firm or corporation who shall violate
any provision of this code shall, upon conviction thereof, be subject to a
fine of not more than $250 or imprisonment for a term not to exceed 15 days,
or both, at the discretion of the court. Each day that a violation continues
after due notice has been served in accordance with the terms and provisions
hereof shall be deemed a separate offense.[1]

PM-110.2.1 Membership. The Board shall consist of five members appointed
by the Mayor. The members shall be residents of the City of Lockport, New
York, and shall serve without pay. Members of the Board who are first appointed
shall be designated to serve for terms of one-, two-, three-, four- and five
years, respectively, from the date of their appointment. A member shall continue
to hold office as long as such member continues to reside in the City of Lockport,
New York, and until his successor is appointed and has qualified. A majority
of the members shall constitute a quorum. Appointments of successors shall
be for the full term of five years, except that the appointment of a person
to fill a vacancy of an unexpired term of any member shall be filled for such
unexpired term only.

PM-111.4 Restraining actions: Anyone affected by any such order shall,
within 15 days after service of such order, apply to a court of record for
an order restraining the code official from razing and removing such structure
or parts thereof. The court shall determine whether the order of the code
official is reasonable, and if found reasonable, the court shall dissolve
the restraining order, and if found not reasonable, the court shall continue
the restraining order or modify it as the circumstances may require.
