No person shall conduct the trade, business or calling of employing of a master plumber and master electrician in the Town of Mount Pleasant until he has applied for and obtained a license from the County of Westchester.
A. 
No person shall do any wiring for the installation of any device, appliance or apparatus for the utilization of light, heat, power, or alarm system unless such person has an electrician's license issued by the County of Westchester.
B. 
No person shall conduct the trade, business or calling of a plumber unless such person has a plumber's license issued by the County of Westchester. Such license or authorization is necessary to practice plumbing as defined in the New York State Uniform Fire Prevention and Building Code.
A. 
An electrical job permit is required to do any electrical work in the Town of Mount Pleasant. The applicant shall file with the Building Inspector a completed application form designated by the Building Inspector with a description of the work, any plans or diagrams that the Building Inspector deems necessary, and the permit fee as established herein.
B. 
An inspector must approve all electrical work. An "inspector" is defined as a third-party inspection agency approved by the Town of Mount Pleasant ("inspector").
C. 
Before concealing any part of the electrical work from view, the electrical contractor must give the inspector written notice of when the electrical work is ready for inspection, and the inspector must conduct an inspection and approve the work.
D. 
Before connecting service lines or using the installation, the electrical contractor must obtain a certificate of approval from the inspector.
E. 
After a certificate has been issued, the inspector shall have the right to reinspect any work to ascertain if the work in question is kept in good condition and that no violation exists. The inspector shall have the authority to turn off all current in excess of 50 volts when, in his opinion, the condition of the installation is dangerous to life or property.
A corporation, partnership, limited liability corporation or any type of entity desiring or intending to conduct the trade, business or calling of a plumber or electrician in the Town of Mount Pleasant as employing a master plumber or master electrician may do so, provided that one or more officers of such corporation who hold licenses as provided in this chapter, separately or aggregately, actually hold or own at least 51% of the issued and outstanding capital stock of said corporation. Such corporation shall register at the office of the Building Inspector as provided in this chapter. No corporation, partnership, limited liability corporation or any type of entity shall practice or engage in the plumbing or electrical business as defined in this chapter except as herein prescribed. Any violation of any provision of this chapter by such corporation, partnership, limited liability corporation of any type of entity shall constitute a violation of this chapter by the officers/members of such corporation, partnership, limited liability corporation or any type of entity holding plumbing or electrical licenses.
The Town Board may, from time to time, impose such other requirements for engaging in the trade, business or calling of a plumber or electrician in the Town of Mount Pleasant as shall be in the public interest.
The Building Inspector of the Town of Mount Pleasant or an assistant thereto who shall be a duly licensed resident master plumber or master electrician, either of whom is hereinafter referred to as the "inspector," shall have charge of the enforcement of this chapter and shall inspect the construction and alteration of all plumbing or electrical work promptly and file reports, in writing, thereon in the office of the Building Inspector. For such purpose, such inspector shall have the right to enter and inspect at any time any building, structure or premises and to perform any other act necessary for the enforcement of this chapter.
Wherever there is reported to the inspector a violation of any rule or regulations of this chapter or a deviation from any officially approved plans or specification for plumbing, drainage or electrical work filed hereunder, the inspector shall, if after an inspection such violation or deviation is found to exist and in cases deemed to be emergency cases, forthwith serve a notice of the violation upon the master plumber or master electrician who did the work, if a licensed plumber or electrician, and upon either the owner or lessee of the building or premises whereon the work was done.
The notice provided for in the preceding section shall be served personally or by registered mail. In the case of a licensed plumber or electrician, the notice, if served by mail, shall be addressed to him at the address registered by him with the Building Inspector and/or the County of Westchester, but the failure of a master plumber or electrician to register properly will waive the requirement of giving notice. Unless the violation is removed within three days after the service of the notice, exclusive of the day of serving or mailing, each additional day such violation shall continue shall constitute a separate violation.
The plumbing, drainage or electrician work hereafter constructed upon all premises and in all buildings now erected or hereafter erected, both public and private, shall be constructed in accordance with the provisions of this chapter and the New York State Plumbing, Fuel, Gas and Mechanical Code, as well as the National Electrical Code ("NEC") (hereinafter the "state code").
Any person, firm, corporation, partnership, limited liability corporation, or any type of entity or association violating any rule, regulation or provision of this chapter shall be subject to a civil penalty of $250 for each violation thereof. The violation of any rule, regulation or provision of this chapter shall be a misdemeanor, and, upon conviction thereof, the person so convicted shall be subject to a fine not exceeding $250 for each such violation, or to imprisonment for not exceeding 15 days for each such violation, or both. If any licensed master plumber or electrician shall be convicted of a violation of any rule, regulation or provision of this chapter, such conviction shall be deemed to constitute such person an undesirable person to conduct the business of plumbing or electrical work as a master or employing plumber or electrician, and said permit issued to him may be revoked in addition to any other penalty herein imposed.
No person other than a licensed plumber or electrician holding a license issued by the County of Westchester shall make connections with any public sewer system in the Town or with any public water system in the Town.
Before any plumbing or electrical work involving the installation, alteration or construction of plumbing or electrical work in any building in the Town of Mount Pleasant, both public and private, shall be commenced, a permit therefor shall be obtained from the inspector, unless such plumbing or electrical work shall involve the installation of a new fixture and/or work only on the house side of existing traps without any interference with the traps. In the case of all plumbing work involving work on the sewer side of any trap, a permit shall be required, and there shall be submitted with the application for a permit a sketch/plan in ink showing the layout of vents, wastes and the drainage system and of the water distribution system before the permit shall be issued, except that a permit may be issued to replace fixtures which involve work on the sewer side of the traps without the submission of such ink sketches/plans, and further provided that riser diagrams shall not be required in any case where fewer than 13 fixtures are to be installed. A permit shall also be required for the replacement of electric, oil-fired or gas water heaters and all gas appliances. Any electrical work installed on the house side of the Con Edison meter shall require detailed plans and specifications approved by the Building Inspector and/or the inspector. The fees for the inspection of the completed work, in accordance with the schedule contained in § 157-119, shall be paid to the Building Inspector before any permit shall be issued. Application for a change in plans or work in the building shall be made in writing by the plumber or electrician, signed by the owner or his agent, and a written permit obtained from the inspector before any part of the change is begun.
