The following officials are hereby authorized to issue summonses, returnable
within 14 days in the Town Court, for any violation of any law or ordinance
of the town under their respective jurisdiction:
A.
Where a law or an ordinance of the town requires prior written notice, all officials listed in § 192-1 above shall be required to give written notice of the existence of any violation of said law ordinance prior to issuing a summons.
B.
Exception. When, in the opinion of any official listed
above, a violation exists which creates an imminent threat to the life, health
or safety of any individual or property or where construction, renovation,
repairs, demolition or other work is being performed without a license or
permit required by law or the ordinances of the town, a summons may be issued
immediately, notwithstanding any provision for prior written notice.
The form of the summons issued by any official named above shall be
governed by the Criminal Procedure Law (CPL) and the Uniform Justice Court
Act (UJCA) of the State of New York and shall be subject to approval by the
Town Board. The content of such summons and the method of prosecution shall
be subject to the CPL and the UJCA.
