The purpose of this chapter is to resupersede Subdivisions 4 and 5 of
§ 271, as last amended by Chapter 663 of the Laws of 1992, Chapters
208 and 211 of the Laws of 1993 and Chapter 486 of the Laws of 1994, of the
Town Law of the State of New York in its application to the Town of Newburgh
with respect to the terms of appointment of the members of the Town of Newburgh
Planning Board. The Town Board has determined that in order to increase the
participation of a concerned citizenry in the planning process and thereby
protect and promote the public health, safety and welfare of the town, the
town shall hereby change the terms of office provided for in Subdivisions
4 and 5 for the term of office of members of the Planning Board. In all other
respects and except as expressly modified herein, § 271 remains
applicable to the Town of Newburgh.
Upon the expiration of the term of each current member of the Town of
Newburgh's existing seven-member Planning Board in office as of the effective
date of this chapter, his or her successors shall be appointed or he or she
shall be reappointed for a term of three (3) years. If a position is vacant
by expiration of term on the effective date of this chapter, the member previously
holding that position shall be reappointed or his or her successor appointed
for a term expiring three (3) years from the prior date of expiration of said
member's term. Thereafter, upon the expiration of the term of each member,
his or her reappointment or the appointment of his or her successor shall
be for a term of three (3) years.
If a vacancy shall occur otherwise than by expiration of term, it shall
be filled by the Town Board by appointment for the unexpired term.
