No person shall be allowed or permitted to enter
on Chadwick Lake (the "lake") and Chadwick Lake Park property (the
"park") in the Town of Newburgh without first obtaining an annual
permit issued pursuant to this article by the Town Clerk or the Clerk's
designee(s).
Permits shall entitle the holder to enter on
the property subject to the following rules and regulations:
A. There shall be no hunting, shooting, unauthorized
camping, swimming or wading, and no dogs shall be allowed. Notwithstanding
the above, the lake and/or park caretakers shall be allowed to have
on the premises a dog for security purposes. Ice fishing is allowed
only in designated areas during open hours, conditions permitting.
A permit is required for ice fishing.
B. Picnicking will be confined to those areas posted
by appropriate signs, and no facilities shall be erected or constructed
without permission of the person or persons in charge of the property
pursuant to an agreement for management with the Town Board.
C. All trash, garbage or other refuse shall be cleaned
up before leaving the areas, and the site shall be policed and left
in good condition.
D. All recyclables should be placed in proper receptacles.
Recyclables subject to this requirement include but are not limited
to glass, aluminum, newspaper (tied with string), tin cans and plastic
bottles.
E. Any unnecessary noise, littering, unauthorized use
of alcoholic beverages or unprescribed controlled drugs or other misbehavior
shall result in the revocation of a permit, as will failure to show
the permit when requested by lake or park personnel.
F. Children under 16 years of age must be accompanied
at Chadwick Lake by an adult permit holder, and such children need
not obtain a permit if so accompanied.
G. Bicycles must be parked in designated areas at the
park's entrance. No bicycle riding is permitted within the park.

A. Boating and fishing privileges are available on special
permit on the following basis and upon compliance with the following
additional rules and regulations:
(1) Effective as of May 20, 2005, no new private boat
permits will be issued for Chadwick Lake use. Notwithstanding the
foregoing, private boat permits may be reissued annually to holders
of unrevoked permits issued during the calendar year 2004 and during
the calendar year 2005 prior to May 20, 2005; provided, however, that
if such a permit holder shall fail to renew the private boat permit
during any subsequent year or such permit shall be revoked, then the
right to renew shall be forfeited and the permit holder shall have
no further right to a private boat permit.
(2) Every privately owned boat must be registered, identified
by number, inspected and approved by the Chadwick Lake caretaker and
must be removed by December I. Prior to being taken onto Chadwick
Lake, any boat removed from the park and any boat brought to the park
for the first time must be steam cleaned by an authorized Town employee.
A fee for each such cleaning shall he charged as per the schedule
adopted by resolution of the Town Board of the Town of Newburgh. The
Town of Newburgh and its employees will assume no legal responsibility
for private boats stored on Chadwick Lake property at any time. (Each
boat must be equipped with a personal flotation device approved by
the Coast Guard for each occupant.)
(3) Children under 16 years of age must be accompanied
by an adult when fishing from a boat.
(4) The manufacturer's capacity rating of each boat shall
not be exceeded at any time.
(5) Fishing and boating shall he limited to the hours
posted by the Town of Newburgh at Chadwick Lake; copies of hours of
operation are also available at Chadwick Lake.
(6) All boats must return to shore 1/2 hour prior to the posted closing time. Failure to return by closing time will result in a late fee as prescribed by Chapter
104, Fees.
(7) No gasoline motors shall be permitted on any boat
excepting for the patrol boats operated by the person or persons in
charge of the property. Electric motors are permitted on private and
public boats.
(8) No private docks may be erected, and no boats may
be left overnight in the water.
(9) Boating, fishing and trespassing are prohibited within
500 feet of the water supply intake at the lake.
B. The following shall be grounds to revoke any boat
permit:
(1) Leaving the boat in a messy condition or in an unauthorized
location or failure to return oars and/or other equipment to the proper
station.
(2) Refusal to show permit when requested by authorized
personnel.
(3) Failure to report damage or loss of equipment.
(4) Violation of fish and game laws.
(5) Littering of the premises.
(6) Violation of any other rules and regulations relating
to the use of Chadwick Lake and Chadwick Lake Park property.
C. Private boat permits shall not be reissued to anyone
failing to remove their boat from the premises by December 1.

A. Picnicking, fishing and parking permits shall be issued
by the Recreation Department during regular office hours on the following
basis:
(1) Residents of the Town of Newburgh and nonresident
property owners of the Town of Newburgh, including spouse and children
up to the age of 18 resident in the household: as per the schedule adopted by resolution of the Town Board of the Town of
Newburgh.
(2) Senior citizens who reside or own property in the
Town of Newburgh: as per the schedule adopted by resolution of the
Town Board of the Town of Newburgh.
(3) All others, including their spouses and children,
up to the age of 18 residing in the household: as per the schedule
adopted by resolution of the Town Board of the Town of Newburgh.
(4) A one-day permit fee shall be: as per the schedule
adopted by resolution of the Town Board of the Town of Newburgh.
B. Permit holders may bring guests onto the lake and/or
park property under the following conditions:
(1) Chadwick Lake (fishing/boating).
(a)
Guest limit: four per day.
(b)
Fee: as per the schedule adopted by resolution
of the Town Board of the Town of Newburgh.
(2) Chadwick Lake Park (all other areas).
(b)
Fee: as per the schedule adopted by resolution
of the Town Board of the Town of Newburgh.
C. Said permits shall be effective for the period beginning
April 1 of each year and shall expire on the following March 31.

A fishing permit must be held in order to obtain
a special boating permit issued by the Recreation Department.
A. Placing private boats on Chadwick Lake. Fees shall
be as per the schedule adopted by resolution of the Town Hoard of
the Town of Newburgh.
(1) Residents of the Town of Newburgh and nonresident
property owners of the Town of Newburgh, including spouses and children
up to the age of 18 residing in the household: as per the schedule
adopted by resolution of the Town Board of the Town of Newburgh.
(2) Senior citizens, including spouses: as per the schedule
adopted by resolution of the Town Board of the Town of Newburgh.
(3) All others, including spouses and children up to the
age of 18 residing in the household: as per the schedule adopted by
resolution of the Town Board of the Town of Newburgh.
B. Daily rental of public boats. Fees shall be as follows:
(1) Residents of the Town of Newburgh and nonresident
property owners of the Town of Newburgh, including spouses and children
up to the age of 18 residing in the household, per boat: as per the
schedule adopted by resolution of the Town Board of the Town of Newburgh.
(2) All others, including spouses and children up to the
age of 18 residing in the household, per boat: as per the schedule
adopted by resolution of the Town Board of the Town of Newburgh.
(3) Half-day (after 1:00 p.m.).
(a)
Residents of the Town of Newburgh and nonresident
property owners of the Town of Newburgh, including spouses and children
up to the age of 18 residing in the household, per boat: as per the
schedule adopted by resolution of the Town Board of the Town of Newburgh.
(b)
All others, including spouses and children up
to the age of 18 residing in the household, per boat: as per the schedule
adopted by resolution of the Town Board of the Town of Newburgh.
(4) Paddle boat rentals may be available. Anyone under
age 16 riding in a paddle boat must be accompanied by an individual
over the age of 16. A personal flotation device must be worn by each
occupant. The paddle boat rental fee is as per the schedule adopted
by resolution of the Town Board of the Town of Newburgh, per person,
per hour, two-hour limit.
C. Service clubs, with the prior approval of the Town
Board and subject to such conditions as the Town Board determines
to impose, may place boats on Chadwick Lake for exclusive use of senior
citizens to be used on a first-come, first-served basis, free of charge.
D. The burden of proof of residence and age rests with
the applicant and shall be furnished to the satisfaction of the Town
Clerk, the Clerk's designee(s) and the Town.
Homeowners' associations, Sunday School groups,
scout groups and other similar organizations or groups may, on written
application to the Town Board, be granted special use permits without
charge.
