Whenever the requirements of this chapter are
at variance with the requirements of any other lawfully adopted rules,
law or ordinances, the most restrictive or that imposing the higher
standards shall govern.
This chapter shall be the rules and regulations
governing the Planning Board. No building permit or certificate of
occupancy shall be issued by the Building Inspector except where all
the provisions of this chapter, as approved by the Planning Board,
have been complied with.
A.
No permit for the erection of any building shall be
issued unless the lot upon which said building is to be constructed
has frontage upon an existing public or private street or a proposed
public or private street appearing on a recorded plat approved by
the Planning Board.
B.
No such permit shall be issued unless such street
has already been suitably improved or unless a performance security
has been posted to cover the full cost of such improvement.
A certificate of occupancy for a structure or
use shall not be issued unless a street providing access to such structure
or use has been suitably improved.

Applications for minor subdivision plat approval which
have been submitted to the Planning Board and accepted as complete
by the Board at a meeting prior to the effective date of this chapter
shall remain subject to the prior Subdivision Law adopted by the Planning
Board on June 15, 1978, and approved by the Town Board on June 19,
1978, as amended, incorporated herein by reference, rather than the
requirements and standards of this chapter.
B.
Applications for major subdivision preliminary plat
approval which have been submitted to the Planning Board and accepted
as complete by the Board at a meeting prior to the effective date
of this chapter shall remain subject to the application requirements
of the prior Subdivision Law adopted by the Planning Board on June
15, 1978, and approved by the Town Board on June 19, 1978, as amended,
incorporated herein by reference, rather than the requirements of
this chapter. Applications for final plat approval for said major
subdivision, however, shall be subject to the requirements and standards
of this chapter, except in the event that said applications and final
plats have been submitted to the Planning Board and accepted as complete
by the Planning Board prior to the effective date of this chapter.
C.
Applications for major subdivision final plat approval
which have been submitted to the Planning Board and accepted as complete
by the Board at a meeting prior to the effective date of this chapter
shall remain subject to the prior Subdivision Law adopted by the Planning
Board on June 15, 1978, and approved by the Town Board on June 19,
1978, as amended, incorporated herein by reference, rather than the
requirements and standards of these this chapter.
The previously enacted Subdivision Law of the Town of Newburgh adopted by the Planning Board and approved by the Town Board on June 19, 1978, are hereby repealed, except in their application to pending minor subdivision plat applications, major subdivision preliminary plat applications and major subdivision final plat applications as provided in Article VI, § 163-30, above.
