The provisions of this Article shall apply except
when it is necessary to stop a vehicle to avoid conflict with other
traffic or in compliance with the directions of a police officer or
official traffic control device.

A.
Legislative intent. By the adoption of this section,
the Town of Newburgh declares its intent to regulate the parking of
motor vehicles on any street within the Town of Newburgh from November
15 to April 15 of every year. This section is enacted in order to
facilitate the proper removal of snow and ice accumulations on any
street within the Town of Newburgh. Reference is made to the Municipal
Home Rule Law of the State of New York, § 22, for legislative
authority to so enact this section.
B.
Definitions.
(1)
The words and phrases and definitions of words as
used in the New York State Town Law shall be applied in the enforcement
of this section.
(2)
PARKING
STANDING
VEHICLES
Additionally, specific reference is made to the following
definitions:
Leaving a motor vehicle, occupied or not occupied, or any
other vehicle in a stationary position within limits of a public street
otherwise than for the purpose of and while actually engaged in the
loading or unloading of merchandise or receiving or discharging passengers.
Leaving a motor vehicle, occupied or not occupied, or any
other vehicle in a stationary position within the limits of a public
street otherwise than for the purpose of and while actually engaged
in receiving or discharging passengers.
Any self-propelled motorized vehicle using any street.
C.
Parking regulations from November 15 to April 15 of
every year.
(1)
During the following period, November 15 to April
15 of each calendar year, it shall be unlawful for any person to park
a motor vehicle or to allow that vehicle to remain parked anywhere
on any street in the Town of Newburgh when snow and/or ice is present.
(3)
In order to assist the operators of motor vehicles
in the Town of Newburgh, signs shall be placed on any street leading
into the Town of Newburgh with the wording "No Parking on Any Street
in the Town of Newburgh From November 15th to April 15th of Each Year
When Snow and/or Ice is Present."
D.
Penalties for violation. In addition to the fine specified in § 174-33, the Superintendent of Highways shall notify the Police Department where there has been a violation, and the Police Department is hereby authorized to move and store any vehicle parked in violation of this section. The Police Department shall not release any such vehicles so removed until the cost, as certified to the Police Department, of removal, including towing and storage, shall have been paid.
No person shall park a vehicle in any parking
space designated for handicapped parking unless the driver or a passenger
is the holder of a handicapped parking permit and said permit is openly
exhibited in a window of the motor vehicle occupied by said permit
holder.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XII (§ 174-45), attached to and made a part of this chapter.

A.
Legislative intent. By adoption of this section, the
Town of Newburgh declares its intent to regulate the parking of vehicles
over 25 feet in length on any Town highway within the Town of Newburgh.
B.
PARKING
Definitions. The definitions set forth in § 174-16B are hereby incorporated in this section by reference, except "parking" shall be defined as follows for purposes of this section:
Leaving a motor vehicle, occupied or not occupied, or any
other vehicle in a stationary position within the limits of a public
street otherwise than for the purpose of and while actually engaged
in the loading or unloading of merchandise, receiving or discharging
passengers, or the provision of a commercial service at an adjacent
or nearby property.
C.
Parking regulation.
(1)
No person shall park any vehicle over 25 feet
in length, or any combination of motor vehicle and attached trailer,
semitrailer or motor vehicle in tow over 25 feet in total length,
on any Town highway; except motor homes, recreational vehicles and
motor vehicles with camper trailers in tow over 25 feet in total length
may be parked on a Town highway for a period not to exceed 72 hours.
(2)
The following streets are excepted from the
above provisions:
(a)
Such streets which the Town of Newburgh Town
Board designates to be excepted from the above requirements from time
to time.
(3)
In order to assist the operators of motor vehicles
in the Town of Newburgh, signs shall be placed on any street leading
into the Town of Newburgh with the wording: "No parking on any Town
highway in the Town of Newburgh of vehicles over 25 feet in length.
No person shall stop a vehicle upon any of the streets or parts of streets described in Schedule XIII (§ 174-46), attached to and made a part of this chapter.
No person shall stand a vehicle upon any of the streets or parts of streets described in Schedule XIV (§ 174-47), attached to and made a part of this chapter.
No person shall park a vehicle between the hours specified in Schedule XV (§ 174-48) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall stop a vehicle during the times
specified in Schedule XVI (§ 171-49) of any day, unless
otherwise indicated, upon any of the streets or parts of streets described
in said schedule, attached to and made a part of this chapter.
No person shall stand a vehicle during the times specified in Schedule XVII (§ 174-50) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule XVIII (§ 174-51) at any time between the hours listed in said schedule of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XIX (§ 174-52), attached to and made a part of this chapter, except at the angle designated and only within the painted stall lines. On all streets or portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb.
The locations described in Schedule XX (§ 174-53), attached to and made a part of this chapter, are hereby designated as loading zones.
The locations described in Schedule XXI (§ 174-54), attached to and made a part of this chapter, are hereby designated as taxi stands.
The locations described in Schedule XXII (§ 174-55), attached to and made a part of this chapter, are hereby designated as bus stops.
A.
Applicability. The following traffic regulations shall
apply to all shopping centers, strip malls or other commercial establishments
with 10 or more parking spaces.

B.
Fire lanes. A fire lane is hereby established extending
from all curblines in which the parking, standing or stopping of vehicles
is prohibited except when it is necessary to stop a vehicle to avoid
conflict with another vehicle. A fire lane shall extend from the curbline
to the nearest designated parking area.
C.
Parking at fire hydrants and driveways and on sidewalks.
(1)
No person shall stop, stand or park a vehicle within
15 feet of a fire hydrant except when such a vehicle is attended by
a licensed operator or chauffeur who is seated in the front seat and
who can immediately move such vehicle in case of emergency, unless
a different distance is indicated by official signs, markings or parking
meters.
(2)
Except when necessary to avoid conflict with other
traffic or in compliance with law or the directions of a police officer
or official traffic control device, no person shall:

A.
Regulations applicable to Barclay Manor Condominium.
The following traffic regulations shall apply to Barclay Manor Condominium:
(1)
Fire lane. A fire lane is hereby established
as marked, striped and indicated by signage. Parking, standing or
stopping of vehicles is prohibited in the Barclay Manor Condominium
fire lane.
(2)
Parking, stopping or standing a vehicle in a
handicapped parking area is prohibited, unless the owner of the vehicle
has been issued an appropriate disability license from the Bureau
of Motor Vehicles or a permit by the Newburgh Town Clerk.
B.
Regulations applicable to Highland Village Condominium.
The following traffic regulation shall apply to Highland Village Condominium
(Maggie Road):
(1)
Parking, stopping or standing a vehicle in a
handicapped parking space is prohibited unless the owner of the vehicle
has been issued an appropriate disability license from the Bureau
of Motor Vehicles or a permit by the Newburgh Town Clerk.
