The Town Board does hereby determine that the enumeration of all buildings in the Town of Southport in a manner which will facilitate the location of buildings along the roads, highways and public right-of-ways by fire, police and other emergency services is of major importance to the Town of Southport. The Town Board further determines that a system of building enumeration which is compatible with and enhances the establishment and operation of a county-wide emergency 911 telephone system is also of major importance to the Town of Southport. This chapter is intended to serve these purposes.
All buildings in the Town of Southport existing and hereafter constructed shall have displayed either upon the building or upon an acceptable freestanding display post or similar fixture located within the front yard of said building an assigned number that uniquely identifies the building's location upon that particular road, highway, or other public right-of-way. Only one principal building upon any individual parcel shall be required to have and display the assigned number.
A. 
The Coordinator of Chemung County Enhanced 911 Emergency Telephone Service shall assign each existing building a number.
B. 
The Code Enforcement Officer shall assign a number to any new building after the issuance of a building permit and prior to the issuance of a certificate of occupancy. The building number and street name shall be written on the face of each new certificate of occupancy. No certificate of occupancy shall be issued until the building is properly numbered and the number is properly displayed in accordance with this chapter.
A. 
The figure or figures comprising the number to be displayed shall be:
(1) 
In Arabic numerals of a color that provides sharp contrasts to the immediate background:
(2) 
A minimum height of four inches;[1]

(3) 
Unobstructed from view and plainly legible from the center of the roadway at all times between sunrise and sunset;
(4) 
Sufficiently reflective or illuminated as to be readily visible at night.
B. 
The figure or figures comprising the number to be displayed on a building shall be affixed either:
(1) 
In a prominent and conspicuous place upon that side of the building facing the roadway upon which the number has been assigned; or
(2) 
Upon a freestanding man-made signpost or similar fixture erected within the front yard of said building adjacent to the driveway entrance leading to the building. No freestanding signpost or fixture used to display a building's assigned number may be erected on that side of any roadway opposite the subject property or in any location other than the front yard of the building to which a number has been assigned nor shall it be erected within the highway right-of-way.
C. 
In those instances where a new structure is to be constructed adjacent to the intersection of roads, on a corner lot, the number will be assigned according to the road that the structure faces.
Each owner, lessee, occupant, or agent of the same, of every building shall cause the same to be numbered, and the number to be displayed, in accordance with this chapter.
All existing buildings shall display the assigned number in the manner provided by § 227-4 of this chapter within 60 days of the assignment of a number by the Coordinator of Chemung County Enhanced 911 Emergency Service. Any building for which a certificate of occupancy is issued after the effective date of this chapter must display the assigned number prior to the issuance of a certificate of occupancy.
The Code Enforcement Officer shall be responsible for the enforcement of this chapter. In instances of unique practical difficulties presented by individual properties, the Code Enforcement Officer shall have authority to vary the specific standards for building enumeration described in this chapter upon the advice of the Coordinator of Chemung County Enhanced 911 Emergency Telephone Service.
A. 
Any owner, lessee or occupant, or agent of the same, of a building who fails to display the assigned building number in accordance with this chapter shall be deemed in violation of this chapter.
B. 
The Code Enforcement Officer shall notify the owner of any building that fails to comply with this chapter of such failure and of the owner's responsibility under this chapter. This notice may be served personally upon the owner or by mailing a copy thereof to the last known address of the building owner. The notice shall warn the owner that failure to bring the building into compliance within 60 days of the service of the notice may result in the posting of the assigned number by Town or County officials. If the building is not in compliance within 60 days of service of this notice, the Town Highway Superintendent, upon the advice of the Coordinator of Chemung County Enhanced 911 Emergency Telephone Service, may cause the assigned number to be posted. The Town Highway Superintendent shall report the costs of numbering the building to the Town Board which may order the Town Assessor to assess the cost of the same upon such premises, and the Assessor shall include the same in the next assessment roll.
C. 
A proceeding to enforce this chapter may be brought in the Town Justice Court by the Code Enforcement Officer without the service of notice referenced in Subsection B.
Any violation of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article III, General Penalty, of the Code of the Town of Southport.
