A Parks and Recreation Commission is hereby created for the City of Coatesville, Chester County, Pennsylvania, known as the "Coatesville Parks and Recreation Commission."
The Commission shall be composed of seven members. All members shall be residents of Coatesville, appointed by the Council of the City of Coatesville, and shall serve four-year terms. Recommendations for members may be made by the Parks and Recreation Commission. Terms of the members shall be staggered in such a manner that at least one expires annually. Six will have two-year terms, with one having a one-year term.
A. 
The Parks and Recreation Advisory Board shall consist of a representative of the Coatesville Area School District (CASD), YMCA, CYWA, Art Partners and the Coatesville City Youth Associations. The Advisory Board's mission is to make recommendations to the Parks and Recreation Commission for programming objectives. A representative from the Advisory Board will attend all meetings of the Parks and Recreation Commission for the purpose of presenting recommendations and initiatives to the Parks and Recreation Commission.
B. 
Attendance.

(1) 
Any member of the Parks and Recreation Advisory Board absent from three or more consecutive regular meetings of the Parks and Recreation Advisory Board without an approved leave of absence granted by the City Council after public hearing and prior written notice thereof shall be removed from the Parks and Recreation Advisory Board by the City Council of the City of Coatesville.
(2) 
Any member of the Parks and Recreation Advisory Board absent from 20% or more of the regularly scheduled meetings of the Parks and Recreation Advisory Board within any one-year period shall be notified in writing by the City Manager acting on behalf of the City Council of the attendance requirements of this subsection. Any member of the Parks and Recreation Advisory Board who is absent from 20% or more of the regularly scheduled meetings within a one-year period shall thereafter be removed for cause from such position by the City Council with prior written notice after public hearing unless such member resigns in writing or waives the public hearing in writing.
(3) 
Any member of the Parks and Recreation Advisory Board may be removed for cause as determined by the City Council after public hearing and prior written notice thereof.
(4) 
The provisions of this subsection shall not preclude the removal of any member of the Parks and Recreation Advisory Board without cause by the City Council when authorized by state law, City Charter or City ordinance.
All persons so appointed to the Parks and Recreation Commission shall serve their full term, or until their successors are appointed, unless they voluntarily resign or are removed by the City Council for dereliction or neglect of duty.
Any vacancy in the Parks and Recreation Commission occurring otherwise than by expiration of a term shall be filled in the same manner and by the same appointing body as the original appointment and shall be for the unexpired term of said member.
All members of the Parks and Recreation Commission will serve without pay.
The Parks and Recreation Commission shall appoint from its membership a Chairperson and such other officers as it may deem necessary for the orderly procedure of its business and will adopt bylaws, rules and regulations covering its procedures. The Commission shall hold regular meetings, including two work sessions and at least one public meeting each quarter. All public meetings shall be held in accordance with the Sunshine Act.[1]

The Parks and Recreation Commission may, with prior approval of City Council, accept any grants, gifts, requests or donations of services, equipment, real estate or money to be used as specified by the donor or by the terms of acceptance. The Commission shall have no authority to enter into any contract or incur any obligation binding upon the City of Coatesville other than current obligations or contracts to be fully executed within the then-current year and all within the budget appropriations made by the City Council or to be satisfied by funds received from sources other than the city budget.
The City Manager shall appoint the Parks and Recreation Coordinator in accordance with the Home Rule Charter who possesses the necessary qualifications and who has demonstrated by actual work experience his or her ability to organize and direct a community recreation system and supervise the activities of such other personnel as may be deemed necessary in carrying out the program. The Parks and Recreation Coordinator shall report to the City Manager or his designee and be responsive to the Commission in carrying out the goals and objectives of the Commission.
Summary of Parks and Recreation Commission major functions.

To define the objectives of public recreation services and make plans harmonizing with them.
B. 
To maintain the highest quality and standard of recreation service.
C. 
To interpret the importance and need of recreation services to the general public.
D. 
To keep public officials informed of the status and progress of recreation services.
E. 
To work collaboratively with public officials to select the recreation and park executive and define his or her duties and responsibilities.
F. 
To establish a sound fiscal plan to achieve recreational goals.
G. 
To provide for an adequate system of recreation areas and facilities.
H. 
To give stability and continuity to general operations.
I. 
To evaluate the services of recreation system in relation to its objectives.
The funds appropriated by the City Council and budgeted to the Parks and Recreation program shall be disbursed by the Council, the City Manager or his designated administrative staff upon vouchers issued by the Parks and Recreation Commission and within the budget appropriations made. Funds received by the Commission from sources other than budget appropriations shall be deposited by the City Manager and disbursed in accordance with the budget funds, except that funds received by gift, bequest or otherwise shall be disbursed in accordance with the terms of the acceptance thereof. Any interest made by this endeavor will be part of the Parks and Recreation budget.
The Parks and Recreation Coordinator shall make full and complete monthly reports to the City Council or at such other times as may be designated or requested by City Council. The fiscal year of said Commission shall conform to that of the City of Coatesville.
The Parks and Recreation Coordinator shall submit with its annual budget request a comprehensive report covering the forthcoming year which outlines its proposed recreation programs for that year and its plans with respect to the creation, use or modification of the recreational areas and facilities operated by it. The Parks and Recreation Commission shall obtain the prior approval of the City Council for any major modifications or additions to said programs and plans within that year.
Nothing in the bylaws, rules and regulations of the Parks and Recreation Commission shall vest in it any powers, responsibilities or duties not herein authorized.
