The purpose of this Article is to protect, maintain and preserve the
existing and future water sources, supplies and reserves for users of borough
water during the present emergency and during any future emergency which may
occur.
For the purposes of this Article, the following definitions shall apply:
AUTHORITY
The Municipal Authority of the Borough of Matamoras.
EMERGENCY
Any state of facts certified in writing by the Municipal Authority
of the Borough of Matamoras to the Council of the Borough of Matamoras to
the effect that the water resources of the borough are at such a level as
to pose a threat to the health, safety and welfare of the borough. Such emergency
shall continue until the said Authority so notifies Borough Council in writing
that the threat no longer exists.
PERSON
Any person, firm, partnership, association, corporation, company
or organization of any kind.
WATER
Water from the system of the Municipal Authority of the Borough of
Matamoras.
The provisions of this Article shall apply to all persons using water,
both in and outside the borough.
A period of emergency shall go into effect at 12:00 noon on the day
following notice thereof to the public by advertising such notice one (1)
time in a newspaper of general circulation in the borough. The period of emergency
shall continue to exist until 12:00 noon on the day following notice of termination
thereof by advertising such notice in the same manner as above.
The use and withdrawal of water by any person during a period of emergency
for the following purposes is prohibited:
A. Watering yards, etc: the sprinkling, watering or irrigating
of shrubbery, trees, lawns, grass, ground covers, plants, vines, gardens,
vegetables, flowers or any other vegetation.
B. Washing mobile equipment: the washing of automobiles,
trucks, trailers, trailer homes, motorcycles, bicycles or any other mobile
equipment.
C. Cleaning outdoor surfaces: the washing or wetting of
sidewalks, driveways, parking areas, filling station aprons, porches or any
other outdoor surfaces.
D. Cleaning buildings: the washing or wetting of the outside
of dwellings, commercial establishments or any other buildings.
E. Cleaning equipment and machinery: the washing or cleaning
of any business or industrial equipment and machinery.
F. Ornamental fountains: the operation of any ornamental
fountain or other structure or device making similar use of water.
G. Swimming pools: swimming pools and wading pools not employing
a filter and recirculating system; filling or back-washing any swimming or
wading pool, regardless of whether it employs a filter and recirculating system.
H. Escape through defective plumbing: the escape of water
through defective plumbing, which shall mean the knowing permission by any
person for defective plumbing to remain out of repair.
The Mayor shall cave the authority to permit in writing a reasonable
use of water in any case necessary to maintain adequate health and sanitation
standards.

Any person violating any provision of this Article shall, upon conviction,
be sentenced to pay a fine of not more than one thousand dollars ($1,000.)
and costs of prosecution, and in the event of nonpayment of such fine and
costs of prosecution, such person shall be subject to imprisonment for a period
not exceeding ninety (90) days.
The Article is hereby adopted as an emergency measure on the advice
of the Municipal Authority of the Borough of Matamoras, and the Council does,
by the vote by which this Article is adopted, hereby declare that an emergency
exists, which makes it imperative that this Article should become effective
forthwith in order that the public health, welfare and safety might most effectively
be provided for.
The official advertisement of the notice of intention to adopt this
Article shall constitute the original notice of the existence of an emergency,
and this Article shall go into effect without further notice at 8:00 p.m.
on the 12th day of July 1977.
