The purpose of this article is to regulate and control the conduct,
keeping and care of dogs within the Charter Township of East China.
As used in this article, the following terms shall have the meanings
indicated:
Both the owner of title of record and those occupying or in possession
of property premises. The term “owner,” when applied to the proprietorship
of an animal, means every person having a right of property in the animal,
an authorized agent of the owner, and every person who keeps or harbors the
animal or has it in his care, custody or control, and every person who permits
the animal to remain on or about the premises occupied by him.
Includes individuals, corporations, copartnerships and associations.
No person owning or having charge, care, custody or control of any dog
shall cause, permit, or allow the same to run at large or to be upon any highway,
street, lane, alley, court or other public place, or upon any private property
or premises, other than those of the person owning or having charge, care,
custody, or control of such dogs, within the Township unless such dog is at
all times restrained by a chain or leash and is in the charge, care, custody,
or control of a person with the ability to restrain it.
No person owning or having charge, care, custody or control of a dog
shall permit such dog at any time, by loud or frequent or habitual barking,
yelping or howling, to cause annoyance to people in the neighborhood or to
persons utilizing public lands or the public walks or streets.
A.
No person owning or having custody or control of a dog
shall knowingly, or through failure to exercise due care or control, permit
the dog to defecate on public property or on private property without the
consent of the property owner or occupant.
B.
A person owning or having custody or control of a dog
shall be responsible for the removal of any excrement (dog feces) eliminated
by such dog on public property or private property of another without consent
of property owner or occupant, and it shall be a violation of this section
for the person owning or having custody or control of the dog to fail to remove
or provide for the removal, in a sanitary manner, of such excrement (dog feces)
before taking the dog from the immediate area where such excretion occurred.
No owner of a dog, nor any person who owns, leases, or is otherwise
in control of any premises within the Township, shall keep, harbor, or otherwise
permit dogs to be kept within the Township except in compliance with the following:
