[HISTORY: Adopted by the Board of Trustees of the Charter Township of East China 7-18-1983 by Ord. No. 135 (Ch. 3-05 of the 1980 Code). Amendments noted where applicable.]
Game devices shall be registered and arcades licensed and regulated in the Charter Township of East China for the protection and benefit of the health, welfare and safety of the residents of the Township.
For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed them by this section:
ARCADE
Any place open to the public in which three or more game devices are located for public use.
GAME DEVICE
Any machine or device, including but not limited to pinball machines, video and electronic games, operated by means of insertion of a token, coin or similar object or for a consideration paid to the owner or custodian thereof for the purpose of a game or contest of skill or amusement.

A. 
Requirement established. No game device will be operated in the Charter Township of East China in any location open to the public unless the owner, licensee or custodian thereof has registered the same with the Township Clerk and obtained the certificate of registration required by this chapter and conspicuously displays the said certificate of registration at all times on the premises.
B. 
Number of devices authorized. The certificate of registration shall indicate the total number of devices located on the subject premises, and the total number of devices actually on the premises shall at no time exceed the total number of devices authorized by the certificate of registration.
C. 
Records maintained by Clerk. As a condition of issuance of the certificate of registration, the Clerk shall be provided the name and address of the owner or lessee of the subject premises, and the manufacturer and serial number of each device located upon the premises at the time of issuance of the certificate of registration. Any addition or deletion of devices subsequent to the issuance of the certificate of registration shall be provided to the Clerk.
D. 
Expiration. Certificates of registration shall expire on December 31 of each year.
A. 
Requirement established. No person shall establish or operate an arcade in the Charter Township of East China unless a license required by this chapter has been issued and is conspicuously displayed at all times on the premises, together with a valid certificate of registration as required by this chapter.

B. 
Application. Application for an arcade license shall be made to the Township Clerk upon forms provided by the Clerk which shall include the following information:
(1) 
The name, address and telephone number of the applicant. If the applicant is a corporation, partnership, or other organization, the names, addresses and telephone numbers of the officers and the owners of more than a ten-percent interest therein shall be given;
(2) 
Whether any person named or required to be named on the application has ever been convicted of a crime and, if so, the nature of the offense.
C. 
Proof of insurance. Each applicant for a license shall file with the Township Clerk a public liability and property damage insurance policy in the amount of $100,000 for injury to or death of any one person and in the amount of $300,000 for injury to or death of more than one person and in the amount of $50,000 for damages to property. Such insurance shall be written by an insurance carrier duly licensed to conduct business in the State of Michigan and shall be kept and maintained in continuous force and effect as long as the applicant shall be licensed under this chapter. Such policy shall contain an endorsement that any cancellation shall not take effect until 10 days’ notice in writing has been given to the Township Clerk.
D. 
Restrictions. No license shall be issued to any applicant when a person named or required to be named on the application:
(1) 
Age. Is under the age of 18 years of age; or
(2) 
Previous convictions. Has been convicted of an offense involving gambling, controlled substances, criminal sexual conduct involving a minor, accosting or soliciting or contributing to the delinquency of a minor.

(1) 
Arcade license. The annual fee for each license for an arcade shall be in the amount set by resolution of the Board of Trustees, payable to the Township.
(2) 
Each game device. A fee in the amount set by resolution of the Board of Trustees shall be paid for each game device actually located on the premises, payable to the Township.

F. 
Inspection for conformance. Upon receipt of the completed application and the license fee, the Clerk shall cause an inspection of the premises to be made by the Township Ordinance Enforcement Officer and Fire Department to insure that it conforms to all applicable Township codes and the standards herein set forth.
G. 
Grant of license. Upon receipt of a satisfactory report from the Township Ordinance Enforcement Officer and Fire Department and upon the determination that the applicant is eligible for a license, the Clerk shall issue the license which shall expire on the following December 31, regardless of the date the license was issued.
H. 
Renewal. Licenses shall be renewed on December 31 of each year upon payment of the annual license fee and upon resubmission of an application and compliance with this section.
I. 
Revocation. The Township Board may, after notice to licensee and an opportunity to be heard before the Township Board, revoke any license issued hereunder in the event it shall determine the licensee to be in violation of any of the requirements or prohibitions of this chapter.
All arcades located in the Charter Township of East China shall conform to the following standards:
A. 
Location. Shall not be located within 500 feet in any direction from the boundaries of any public, private or parochial school building and school grounds;
B. 
Rest rooms. Shall have at least two on-premises and separate public rest rooms, one for female patrons and one for male patrons;
C. 
Facilities for handicapped persons. Shall be equipped with safety and convenience facilities to accommodate handicapped persons, consistent with applicable state and federal requirements;
D. 
Fire exits. Shall have fire exits as required by applicable Township and/or state codes; and
E. 
Conformance with Township Codes. Shall conform in all respects to the requirements of the applicable Township Building, Plumbing, Electrical and Zoning Codes.
No licensee or person in charge of an arcade or game device or connected with the management thereof or their servants or agents shall:
A. 
Hours of operation.
(1) 
Game devices. Permit the operation of any game device by any person under the age of 18 years of age between the hours of 11:00 p.m. and 7:00 a.m.
(2) 
Arcades. Permit the operation of an arcade between the hours of 2:00 a.m. and 7:00 a.m.
B. 
Gambling. Permit gambling in any form on the premises.
C. 
Persons under the influence. Permit any persons under the influence of intoxicating liquor or controlled substances to be on the premises.
D. 
Liquor or controlled substances. Permit any intoxicating liquor or any controlled substances to be brought, sold, given away or consumed on the premises unless so licensed and permitted by the State of Michigan.
E. 
Disorderly or offensive conduct. Permit disorderly or offensive conduct on the premises as defined under the laws of the State of Michigan.
F. 
Conduct contributing to delinquency. Permit any conduct or condition to exist contributing to juvenile delinquency.
G. 
Loitering. Permit loitering on any public street, sidewalk or right-of-way abutting the arcade so as to obstruct the free and uninterrupted passage of the public.
H. 
Attendant on duty. Operate an arcade unless the owner, operator or an employee or agent of the owner is present on the premises.
